HomeMy WebLinkAboutOrdinance - 7095-1975 - Amending Zoning Ord. #1695 And Lubbock Map For Changes: Zone Case #1840 - 05/12/1975KJ:cab ORDINANCE NO. 7095 -------- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1840: CHANGE A TRACT OF LAND TO BE KNOWN AS TRACT A~ MELONIE PARK SOUTH ADDITION FROM A 11C-311 TO A rrc-211 ZONING DISTRICT: SUBJECT TO CONDITIONS: PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. ,1WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recomrrlendation, which was received by the City Council and after due consi- deration, the City Council finds that making the proposed change as herein- after st out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well tas giving notices in compliance with Section 20 of Ordinance No. 1695 as well ,as notices provided by Article 1011f, Vernon's Annotated Civil Statutes1 amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the publ\c hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amende in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THERE- FORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 1840 Change a tract of land to be known as Tract A, Melonie Park South Addition from rrc-3" to a rrc-2 11 Zoning District. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Development shall be limited to the following uses: KJ:cab R-1, R-2, A-1, A-2, C-1, C-2A & C-2 Uses, plus: Tennis Court Miniature Golf Courses Townhouses Antique, Ceramic, Gift, & Florist Shop Bowling Alley Furniture Store Hardware Store Skating Rink Theater or Motion Picture Show Men's Store Department Store (not of a discount variety) 2. The minimum setback requirement for the North 200 feet shall be 43 feet. SECTION 2. THAT from and after passage and effective date of this Ordinance, said lots, tracts and parcels of land described in Section 1 hereof shall be1 changed to the zoning district indicated and the Official Map is amend d in accorf ance herewith. SECTION 3. THAT should any section, paragraph, sentence, clause, phrase 6'r word of this Ordinance be declared unconstitutional or invalid for any rea~on, the remainder of this Ordinance shall not be affected thereby. I SECTION 4. THAT the City Secretary is hereby author.ized to cause I publication of the descriptive caption of this Ordinance as an alternative method ~rovided by law. AND IT IS SO ORDERED.
