HomeMy WebLinkAboutOrdinance - 7081-1975 - Amending Zoning Ord. #1695 And Lubbock Map For Changes: Zone Case #1998 - 05/21/1975KJ:cab ORDINANCE NO. __ ..~.z.w.Ow.8J..__ __ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOL- LOWING CHANGE: ZONE CASE NO. 1998: CHANGE AI TRACT OF LAND OUT OF SECTION 77, BLOCK A, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO M-1 ZONING DISTRICT. SUBJECT TO CONDITIONS PROVIDING A PENALTY: PROVIDING A SAVINGS CLAUSE AND PROVIDIN FOR PUBLICATION. WHE'REAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation, which was received by the City Council and, after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, an·d notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Chamber on the Second Floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to change conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows; to-wit: ZONE CASE NO. 1998 Change a tract of land out of Section 77, Block A, City of Lubbock, Lubbock County, Texas, from R-1 to M-1 Zoning District. u Property is further described by metes and bounds as follows:" KJ:cab BEGINNING at a point in the West line of Quirt Avenue and in the South line of Queen's Street, said point bears South 1401 feet and West 30 feet from the Northeast corner of Section 77, Block A, Lubbock County, Texas, said point also bears South 60 feet from the Southeast corner of Lot 18, Block 32, CARTER-COFFEY ADDITION to the City of Lubbock, Lubbock County, Texas; THENCE $00"" 17 1E, along the West line of Quirt Avenue, a distance of 47.1 feet to a point of curvature; THENCE Southwesterly, around a curve to the right, said curve having a radius of 215.00 feet, a delta angle of 95°09', tangent lengths of 235.25 feet, and a chord distance of 317.41 feet to a point in the North line of Loop 289; THENCE N85°081W along the North line of Loop 289, a distance of 515. 7 feet, to a point of curvature; THENCE Westerly, around a curve in the North line of Loop 289, said curve having a radius of 5879.65 feet, a delta angle of 5 °12 1, tangent lengths of 26 6. 9 9 feet, and a chord distance of 533. 4 feet to a point in the North line of Loop 289; THENCE S89°401W, along the North line of Loop 289, a distance of 2876. 9 feet; THENCE N85 °341W, along the North line of Loop 289, a distance of 481. 7 feet; THENCE S89°40'W, along the North line of Loop 289, a distance of 221. 5 feet, to a point in the East line of Birch Avenue; THENCE .N:00:0 20'W, along the East line of Birch Avenue, a distance of 150. 00 feet to a point in the South line of Queen's Street. THENCE N80°40'E, along the South line of Queen's Street, a distance of 4859.45 feet to the PLACE OF BEGINNING. -2- KJ:cab SUBJECT TO THE FOLLOWING CONDITIONS: 1. Restricted to a 45 1 setback on the North property line. 2. Restricted to a 25' setback on the South property line. 3. Construction shall be limited to 24' in height. 4. Limited to 40% lot coverage. 5. Signs shall be in accordance with the sign regulations in effect at the time of sign construction. Billboards shall not be permitted. 6. That a solid 6 1 permanent type screening fence of masonry construction shall be erected and permanently maintained on the north property line, excluding the Park. 7. Smoke stacks or outside storage shall not be permitted. 8. The Park area shall be between Ivory and Globe, South of Arnett School. 9. The following uses shall not be permitted: a. Dog Kennels b. Veterinary office or clinic c. Rendering plant d. Packing plant e. Billboards f. Blacksmithing g. Bus terminal h. Creamery and dairy products manufacturing i. Egg storage, candling or processing plant j. Feed store k. Mattress manufacture or renovation 1. Mobile home manufacturing m . Mobile home storage n. Planing Mill o. Sheet metal work shop p. Trailer or Camper manufacture q. Welding shop r . Bars, cocktail lounge and private clubs SECTION 2. THAT from and after passage and effective date of this Ordinance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the Zoning District indicated and the Official Map is amended in accordance herewith. SECTION 3. THAT any person, firm or corporation owning oropera- ting the subject property failing to comply with the conditions imposed by Sec- tion 1 hereof shall be guilty of a misdemeanor and upon conviction thereof, shall e ' . ., J ..... KJ:cab subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day's violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject property to comply with any of the conditions imposed by Section 1 hereof shall render the President, Vice-President, General Manager, Local Manager and Local I' Agent liable to the penalty prescribed in this Section. "" SECTION 4. THAT should any Section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall hot be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. ' !.
