AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC
USE PERMIT, TO-WIT: ZONE CASE NO. 2000; CHANGE A TRACT OF
LAND OUT OF SECTION 23, BLOCK E AND SECTION 2~ BLOCKS, CITY
OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM 11M-211 TO "M-211
SPECIFIC USE PERMIT, TO-WIT: JUNK YARDS, SALVAGE YARDS OR
AUTOMOBILE WRECKING YARDS; PROVIDING FOR A CONDITION;
PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, after receiving the recommendations of the Planning and
Zoning Commission and after due notice and public hearing and all matters
having been done and performed as required by Section 14-A of Zoning
Ordinance No. 1695 of the City of Lubbock, (said Ordinance being an
Appendix to the Lubbock City Code) relating to Specific Use Permits, the
City Council finds that due to changed conditions, it would be expedient and
in the interest of the public health, morals. and general welfare to authorize
the granting of a Specific Use Permit as hereinafter set forth: NOW.
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Director of Planning of the City of Lubbock
is authorized 1D issue a Specific Use Permit to the Applicant in Zone Case
No. 2000 in accordance with the recommendations and conditions imposed
by the Planning and Zoning Commission., on file with the office of the
Director of Planning and the City Council which are hereby adopted and
incorporated herein by reference for all purposes., provided said Applicant
agrees to be bound by the terms of this Specific Use Permit., the granting
of which is hereby made subject to compliance to all provisions of
Zoning Ordinance No. 1695., an Ordinance of the City of Lubbock., including
particularly., but not limited to, Section 14-A of Zoning Ordinance No. 1695
within twenty-four (24) months of the effective date of this Ordinance, the
City Secretary-Treasurer shall be and is hereby authorized and instructed,
upon written notice from the Director of Planning that Applicant has not
complied with the provisions., conditions and terms imposed by this~
Ordinance to note Applicant's failure to comply on the margin of the Minutes
of the City Council opposite entry of this Ordinance., and the authorization
to issue such Specific Use Permit is hereby revoked;.and the Director of
Planning in such event is directed to remove from the Zoning Map the
legend indicating such limited use. The Specific Vse authorized by this
Ordinance is for Junk Yards, Salvage Yards or Automobile Wrecking
Yards, under provision of Section 14-A. 1-21. of the Zoning Ordinance on
the property described below:

ZONE CASE NO. 2000
Change a Tract of Land out of Section 23, Block
E and Section 2., Block S., City of Lubbock,
Lubbock County, Texas., from "M-211 to "M-211
Specific Use Permit, to-wit: Junk Yards.,
Salvage Yards or Automobile Wrecking Yards.
PROPERTY IS FURTHER DESCRIBED BY METES AND BOUNDS. TO-WIT:
BEGINNING at a spike set in North-South fence
line for the SE and beginning corner of this tract,
whence the SW corner of Section 2, Block S., bears
South 0° 4011 East 10061 and S 89° 20" W 2262. 21
and a concrete monument inside the R. 0, W. bears
South 6 feet:
THENCE S 89 ° 1611 West following the North right-of-
way line of P. & S. F. Railroad at 2262. 2 feet across
the West line of Section 2., Block S, and the East
line of Section 23., Block E, and 3292 feet in all to
a spike in No:t?th-South road, (Quirt Avenue) for the
SW corner of this tract: whence the West line of
Section 2 3., bears W 301;
THENCE North 318. 21 to a point for the NW corner
of this tract whence a concrete monument bears East
about 40 feet;
THENCE North 89 ° 2011 East at 1026.1 feet cr:oss
common line of Sections 23 and 2, and in all a distance
of 3288. 3 feet to a concrete monument set in North-
South fence line the NE corner of this tract:
THENCE South of O O 4011 East 314 feet along fence
to the PLACE OF BEGINNING.
Containing 23. 875 acres of land.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. Development shall be in accordance with the Site
Plan approved by the City Council on April

however, such development shall comply
with conditions on the Recorded Plat.
2. A solid 8 foot permanent type screening
fence of wood or masonry construction shall
be erected and permanently maintained around
and enclosing the subject property.
SECTION 2. THAT should any section., paragraph, sentence., clause
phrase or word of this Ordinance be declared unconstitutional or invalid
for any reason, the remainder of this Ordinance shall not be affected
thereby.
SECTION 3. THAT the City Secretary is hereby authorized to
cause publication of the descriptive caption of this Ordinance as an
alternative method provided by law.
AND IT IS SO ORDERED.
