HomeMy WebLinkAboutOrdinance - 7046-1975 - Abandoning And Closing A Power Line Easement And Public Utilities Easement - 02/27/1975JWF:rmj ORDINANCEI"NO. 7046 .....;...;...;..;,.._ __ _ AN ORDINANCE ABANDONING AND CLOSING A POWER LINE EASE- MENT AND PUBLIC UTILITIES EASEMENT LOCATED IN PARTS OF SEC- TION 28, BLOCK E-2, LUBBOCK COUNTY, TEXAS AND MORE PARTICU- LARLY DESCRIBED HEREINAFTER IN TffiS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OFTHE CITY TO REF LE T SAID ABANDONING AND CLOSING; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the POWER LINE EASEMENT and PUBLIC UTILITIES EASEMENT as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be to the public interest to close, vacate, and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION I. THAT said power line and public utility easements are described as follows: POWER LINE EASEMENT THAT the said power line easement being held by the City of Lubbock as the owner of an unrecorded REA power line easement as successor in interest thereto, is described by metes and bounds as follows: BEGINNING at a point 156 south and 1480. 6 feet west of the northeast corner of Secti'on 28, Block E-2, Lubbock County, Texas; THENCE East a distance of 1269. 4 feet to a point in the west line of Lot 9, Buster Long Addition to the City of Lubbock, Lubbock County, Texas; THENCE South along said west line of Lot 9, Buster Long Addition, a distance of 20. 00 feet; THENCE West a distance of 1269. 4 feet; THENCE North a dlstance of 20. 00 feet to the PLACE OF BEGINNING. The west 70 feet of the next-above described tract is also included as a part of a power line easement granted to the City of Lubbock by Glover Leunberger under date of January 30, 1958 of record in Volurre 682, Page 23 of the Deed Records of Lubbock County, Texas. PUBLIC UTILITY EASEMENT THAT the said public utllity easement was granted by Jim Boyer to the City of Lubbock under date of September 6, 1972, and is of record at Volume 1322, Pages 129-130 of the Deed Records of Lubbock County, Texas and is described by metes and bounds as follows: JWF:rm· BEGINNING AT a '.:point that bears South 295. 0 feet and East 1159. 4 feet of the Northwest cocner of the Northeast one-quarter of Section 28, Block E-2, Lubbock County, Texas; THENCE East a distance of 60, 00 feet to a point; THENCE South a distance of 20. 00 feet to a point; THENCE West a distance of 60. 00 feet to a point; THENCE North a distance of 20. 00 feet to the point of BEGINNING. The aforesaid REA Powerline held as an unrecorded owner and succe i:. sor in interest by the City of Lubbock, and the west 70 feet thereof held by the City of Lubbock as a part of the power line easement granted by the afore said GLOVER LEUNGERGER, as hereinabove, set forth and described, and the aforesaid public utility easement granted to the eity of Lubbock by afore- said JIM BOYER. as hereinabove set forth, BE AND THE SAME ARE CLOS VACATED, AND ABANDONED as a power line easement and public utility easement from and after the effectlve date of this Ordinance. Only the two tracts of land hereinaoove described are closed, vacated and abandoned by this Ordinance, all other rights held by the City of Lubbock are hereby re- tained. SECTION 2. THAT the City Engineer shall mark said abandoning and closing on the official traps of the City, giving the number of the Ordinance, and its date of final passage. SECTION 3. THAT the City Secretary is hereby authorized and directed to cause the publication of the descriptive caption of this Ordinance as an alternative method of publication as provided by law.
