AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE OF
ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING
SUBSECTION 16.01.00S(b) OF THE CODE OF ORDINANCES OF THE CITY OF
LUBBOCK BY ADDING AN ADDITIONAL PARK FACILITY TO THE LIST OF
FACILITIES AT WHICH THE SALE AND/OR CONSUMPTION OF ALCOHOL
MAY BE PERMITTED; AMENDING SUBSECTION 16.01 .00S(c) OF THE CODE OF
ORDINANCES OF THE CITY OF LUBBOCK BY PROVIDING FOR REVIEW OF
PERMIT APPLICATIONS; PROVIDING A SA VINOS CLAUSE; AND PROVIDING
FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock deems it to be in the best
interest of the citizens of the City of Lubbock to include in the Code of Ordinances an
additional park facility to the list of facilities at which the sale and/or consumption of
alcohol may be permitted, and to ensure that any such sale and/or consumption be strictly
in compliance with all federal, state, or local regulations; NOW THEREFORE;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1: THAT Subsection 16.0 l .00S(b) of the Code of Ordinances, City of
Lubbock, Texas is hereby amended to read as follows:
Section 16.0 I.00S(b ). Alcoholic beverages prohibited. exceptions. It shall be unlawful
for any person to consume any alcoholic beverage in any public park or for any person to
possess any alcoholic beverage in any public park within the corporate limits of the city
unless otherwise specified by this section.
( 1) The sale and consumption of alcoholic beverages within the Meadowbrook
Golf Course at Mackenzie Park may be allowed in accordance with the laws
of the State of Texas, as administered by the Texas Alcoholic Beverage
Commission.
(2) The sale and/or consumption of alcohol may be permitted at the following
selected park facilities:
(A) The Wells Fargo Amphitheatre;
(B) The American Museum of Agriculture;
(C) The Wind Power Center;
(D) The Buddy and Maria Elena Holly Plaza; and
(E) The Buddy Holly Recreational Area, as depicted in Figure 1 appended
hereto.

SECTION 2: THAT Section 16.01.00S(c) of the Code of Ordinances, City of
ubbock, Texas is hereby amended to read as follows:
(c) Alcoholic beverages permitting procedures. The director of parks and
ecreation shall develop guidelines and procedures to insure the following:
(I) That the sale and/or consumption of alcoholic beverages shall comply
with any and all license agreements entered into by the city;
(2) That the sale and/or consumption of alcoholic beverages shall comply
with all federal, state, and local regulations, including those set forth in the
Texas Alcoholic Beverages Code; and
(3) That the sale and/or consumption of alcoholic beverages is conducted
by special permit obtained from the director of parks and recreation. The
permit shall include, but is not limited to the following information:
(A) The date, time, and location of the event;
(B) The type of event;
(C) The estimated attendance;
(D) The access to the event;
(E) The designation of a licensed and approved concessionaire or
caterer; and
(F) The site management and security.
(4) That any application made for special permit hereunder shall be
resented to the City of Lubbock Parks and Recreation Advisory Board by the director of
arks and recreation prior to the issuance of a permit; provided, however, that this
equirement may be waived by the director of parks and recreation for permit
pplications in connection with events previously permitted hereunder, and for which no
ignificant changes are anticipated by the director of parks and recreation.
SECTION 3: THAT the City Council finds and declares that sufficient written
otice of the date, hour, place, and subject of this meeting of the Council was posted at a
esignated place convenient to the public at the City Hall for the time required by law
receding this meeting, that such place of posting was readily accessible at all times to
he general public, and that all of the foregoing was done as required by law at all times
uring which this Ordinance and the subject matter thereof has been discussed,
onsidered and formally acted upon. The City Council further ratifies, approves and
onfirms such written notice and the contents of posting thereof.

SECTION 4: THAT should any paragraph, section, sentence, phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 5: THAT the City Secretary is hereby authorized and directed to cause
publication of the descriptive caption of this Ordinance as an alternative method of
publication provided by law.
