Underground Utility Easement 5512 4Th - 07/21/2005First Reading May 12,2005 Item 19 f1LE Aim IOURI Tt UBUCYI-0 ... 28~~94 ORDINANCE NO. 2005-o0051 Second Reading May 26,2005 Item9 v•·~ 9975rAcr267 AN ORDINANCE ABANDON1NG AND CLOSING A PORTION OF A 20- FOOT UNDERGROUND UTILITY EASEMENT LOCATED IN SECTION 1, BLOCK J-S, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds the easement hereinafter described in the body of this Ordinance is no longer needed for easement purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, such easement is more particularly described as follows: All of that 20-foot underground utility easement described in Volume 1385, Page 344 of the Records of Lubbock County, Texas located in Section 1, Block J-S, Lubbock County, Texas, save and except the North 165-feet. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. . . .... ... ... THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. Second Reading. BACKGROUND/DISCUSSION: This ordinance abandons and closes a portion of a 20-foot underground utility easement located just north of 4th Street and east of Elkhart Avenue in Section 1, Block J-S. This ordinance was read for the first time at the May 12th City Council as a routine consent agenda item.
