SECTION 40.03.204, "C0NDITI0NJ\L USES" OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK. TEXAS. TO ALLOW RESIDENTS. AS A CONDITIONAL USE. TO MAINTAIN MORE THAN FOUR (4) DOGS ON A RESIDENTIAL LOT; PROVIDIN G A PEN1\LTY: PR0VIDfNG A SAVlNGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS. the City Council of the City of Lubbock. Texas deems it in the bl:sl interest of the health, safety, and welfare of the citizens of Lubbock to amenJ the CoJe of Ordinances to increase from three (3) to four (4) the number of dogs residents are allo\.vcd to maintain in a residential lot as a conditional use and to modify the definition of a Kennel as set forth herein: BE IT ORDAINED BY TH E CITY COUNCIL OF THE CITY OF LUilBOCK: SECTION I. THAT Section 40.03.204 subsection (10) or the Code of Ordinances, City of Lubbock. Texas. is hereby amended to read as follows: ( I 0) Residents requesting that more than four ( 4) adult dogs, more than four ( 4) months of age may be maintained on a residential lot or premises. Such approval shall not provide for a commercial bm:ding business. SL:CTJON 2. THAT Section 40.01.003 subsection (87) of the CoJc or Ordinances. City of Lubbock, Texas, is hereby amended to read as follows: (87) Kennel. Any lot or premises on which live (5) or more Jogs mon: than four ( 4) months of age are kept. SECTION 3. THJ\T violation of any prov1s1011 of this Ordinance shall be deemed a misdemeanor punishable as provided by Section 1.01.004 of the Code of Ordinances of the City of Lubbock. Texas. SECTION 4. THAT should any paragraph, section. clause, phrase or word of this Ordinance be declared unconstitutional or invaliJ for any reason, the remainder of the Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary of the City of Lubbock.
