AN ORDINANCE ABANDONING AND CLOSING RALEIGH A VENUE
BETWEEN THE BROWNFIELD HIGHWAY AND BROWNFIELD DRIVE IN
SECTION 17, BLOCK B, LUBBOCK COUNTY, TEXAS, A 20-FOOT ALLEY WEST
OF RALEIGH AVENUE IN SAID SECTION 17, BLOCK B, AND A FIVE FOOT
SANITARY SEWER LINE EASEMENT LOCATED IN LOT 5, ALLEN ADDITION
TO THE CITY OF LUBBOCK, EACH OF WHICH IS MORE PARTICULARLY.
DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY
ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID
ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND
PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that portions of the street, alley, and easement
hereinafter described in the body of this Ordinance are oo longer needed for street, alley,
and easement purposes and for public use; and the City Council finds it would be in the
public interest to close, vacate and abandon the same for street, alley, and easement
purposes; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the street, alley, and easement portions as hereinafter
described shall BE and the same are hereby closed, vacated and abandoned for street,
alley and easement purposes and for public use, such street, alley, and easement portions
are more particularly described as follows:
1. Raleigh Avenue between Brownfield Highway (US62/82) and Brownfield
Drive being more particularly described the attached Exhibit "A».
2. The 20-foot east-west alley located just west of Raleigh Avenue being
more particularly described in the attached Exhibit "B".
3. The five (5) foot Sanitary Sewer Line Easement located in Lot 5 Allen
Addition to the City of Lubbock, Lubbock County, Texas and recorded in
Volume 776, Page 126 of the Deed Records of Lubbock County, Texas.
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this ordinance shall not be affected thereby.

SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance
as an alternative method provided by law.

# Consider an ordinance abandoning and closing Raleigh Avenue between the
Brownfield Highway and Brownfield Drive, a 20-foot alley west of Raleigh
Avenue in Section 17, Block B, Lubbock County, and a 5-foot sanitary sewer
line easement located in Lot 5, Allen Addition to the City of Lubbock (4505
Brownfield Highway).
BACKGROUND/DISCUSSION:
This ordinance abandons and closes the 17,380 sq. ft. portion of Raleigh Avenue
between the Brownfield Highway and Brownfield Drive, the east-west 8,930 sq.
ft. 20-foot alley just west of the portion of Raleigh Avenue being closed, and a 5-
foot sanitary sewer line easement in Lot 5 Allen Addition for replatting purposes.
The requestor of these closures, Randy Hinkle, was not the original dedicator, so
there will be a charge for the street and alley portions being closed. The total
area of Raleigh Avenue being closed is 17,380 sq. ft. The Right-of-Way
Department has valued this area at $2.00 per sq. ft. for a value of $34,760. The
area will remain as a utility easement so the street will be valued at 50% or
$17,380. The alley area being closed contains 8,930 sq. ft. and is valued at $1.75
per sq. ft. for a value of $15,627.50. Total amount due for the street and alley
closures is $33,007.50.
FISCAL IMPACT:
Income to the City of $33,007.50
SUMMARY/RECOMMENDATION:
The Right-of-Way Department recommends the approval of the first reading of
this ordinance.
