WHEREAS, the City Council fi ds that portion of the street hereinafter described in the body of this Ordinance is no I ger needed for street purposes and for public use; and WHEREAS, the City Co cil finds it would be in the public interest to close, vacate and abandon the same fo street purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE ITY COUNCIL OF THE CITY OF LUBBOCK: SECTION I. THA the street portion as hereinafter described shall BE and the same are hereby closed, v. cated and abandoned for street purposes and for public use, such street is more partie arly described as follows: METES AND OUNDS DESCRIPTION of a portion of North Elder Avenue, Lubb ck County, Texas, located in the Northeast Quarter of Section 2, Bl k A, Lubbock County, Texas, being further described as follows: G at a point in the North right-of-way line of East Cornell Street, wh· h bears West a distance of 645.00 feet and South a distance of 1292. feet from the Northeast corner of Section 2, Block A, ounty, Texas; North, along the centerline ofNorth Elder Avenue, a distance 0 feet to a point; THE CE East a distance of 28.00 feet to a point in the East right-of- ne ofNorth Elder Avenue; CE South, along said East right-of-way line, a distance of 846.00 fee to a point of curvature; THENCE Southeasterly, around a curve to the left, continuing along said East right-of-way line, said curve having a radius of 15.00 feet, a central angle of 90°, tangent lengths of 15.00 feet, and a chord di ce of 21.21 feet to a point in the North right-of-way line of Cornell Street; THENCE West, along said North right-of-way line feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer ish by authorized and directed to mark the official maps of the City of Lubbock to r ect said abandonment and closing, showing the number of this Ordinance and the te of its final passage. SECTION 3. THAT should any s tion, paragraph, sentence, phrase, clause or word of this Ordinance be declared onstitutional or invalid for any reason, the remainder of this Ordinance shall not be ffected thereby. SECTION 4. THAT the 1ty Secretary of the City of Lubbock is hereby authorized and directed to cause p lication of the descriptive caption of this Ordinance as an alternative method provided y law. CITY OF LUBBOCK AGENDA ITEM SUMMARY ITEM #/SUBJECI': # An ordinance abandoning and closing a portion of North Elder Avenue located in the Northeast Quarter of Section 2 Block A, Lubbock County, Texas (2938 East Cornell Street). BACKGROUND/DISCUSSION: This ordinance abandons and closes a 861.00-foot long by 28-foot wide portion of North Elder Avenue located just west of Guava Avenue and south of East Erskine Street. This portion of street right-of-way is being closed for platting and development purposes for a new residential subdivision by Truett Craft. There will be no charge for this street closure since the proponent will dedicate new streets and alleys in the plat. Titis area will remain a temporary underground utility easement and garbage collection easement. All utilities and City departments are in agreement with this closure. FISCAL IMP ACf: None SUMMARY/RECOMEDATION: The Right-of-Way Department recommends the approval of the first reading of this ordinance.
