HomeMy WebLinkAboutOrdinance - 2005-O0022 - Abandoning/Closing A 2 Foot Underground Streetlight Cable Easement For LP&L - 02/24/2005First Reading February 24, 2005 Item 15 File And Return 1 o Ed Bucy R-0-W ORDINANCE NO. 2005-ooo22 9:104 Second Reading March 4, 2005 Item 15 V•1L 9712PAc£22f AN ORDINANCE ABANDONING AND CLOSING A 2 FOOT UNDERGROUND STREETLIGHT CABLE EASEMENT FOR LP&L LOCATED IN LOT 193, DAY ESTATES ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds the easement hereinafter described in the body of this Ordinance is no longer needed for easement purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, such easement is more particularly described as follows: That portion of land granted as a 2.00 foot underground streetlight cable easement in Lot 193, Day Estates, according to the map, plat, and/or dedication deed thereof recorded in Volume 9291, Page 229, Real Property Records of Lubbock County, Texas. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED. Passed by the City Council on first reading this24th day of February , 2005. Passed by the City Council on second reading the 4th day of March '2005. BACKGROUND/DISCUSSION: Tiris ordinance abandons and closes a 2-foot wide Lubbock Power & Light underground street light cable easement located along the east 2-feet of Lot 193 Day Estates Addition, which is located at 94th Street and Hyden A venue. Tills easement is being closed for development purposes and a new easement will be dedicated to replace this closure. LP&L is in agreement with this closure. FISCAL IMP ACT: None
