HomeMy WebLinkAboutOrdinance - 2005-O0021 - Amending Chapter 2 With Regard To The Membership Of City Board Of Health; Saving - 02/10/2005First Reading February 10, 2005 Item No. 19 Second Reading February 24, 2005 Itea No. 13 ORDINANCE NO. 2005-o0021 AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO THE MEMBERSHIP OF THE CITY OF LUBBOCK BOARD OF HEALTH; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to increase the size of the Board ofHealth from seven (7) members to (9) members; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT section 2-187 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: Sec. 2-187. Composition, appointment and terms of members. The city board of health shall be composed of nine (9) members, each of whom shall be a resident citizen ofthe city. The members of the board shall be appointed by the City Council and shall hold office for terms of three (3) years. SECTION 2. THAT section 2-192 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: Sec. 2-192. Quorum; voting. Any and all reconunendations made by the board of health to the City Council shall be by the concurring vote of five (5) members of the board; provided, however, that this provision shall not exclude a minority recommendation which is hereby authorized to be made in writing by less than a majority of the members of the board. The majority of the total members of the board shall constitute a quorum for the transaction of all matters to be considered by it. SECTION 3. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication as provided by law.
