WHEREAS, the City Council finds that the easement hereinafter described in the body of this Ordinance is no longer needed for easement purposes and for public use; and WHEREAS, the City Council fmds it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION L THAT the easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use, such easement is more particularly described as follows: A tract ofland out of theN/51 acres of the SW/4 of Section 25, Block E-2, Lubbock County, Texas: BEGINNING at a W' IR. set in the $/line of the NW/4 of Section 25, for the NW comer of this tract, from whence the NW comer of the SW/4 of Section 25, bearsS 89°42'44" W, 1109.41 ft.; THENCE N. 89° 42'44" E. a distance of60 ft. to a Yz" IR found for the NE comer of this tract; THENCE S. 0° 01'31" E. a distance of300.00 ft. to theSE comer of this easement; THENCE S. 89° 42'44" W. a distance of 60ft. to the SW comer of this easement; THENCE N. 0° 01 '31" W. along the extended W/line of Elkhart Avenue, a distance of300.00 ft. to the Place ofBegirming. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared 1.mconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. BACKGROUND/DISCUSSION: This ordinance abandons and closes a 60-foot wide by 300-foot long drainage easement just south of 104th Street at Elkhart Avenue that was dedicated with the West Lake Estates plat. The area south of this addition is being platted and a street dedicated where this drainage easement being closed is located and the easement is no longer needed. FISCAL IMP ACI': None.
