HomeMy WebLinkAboutOrdinance - 2005-O0004 - E-Maili Awaiting Second Reading; Won't Go To Second Reading/Change Of Ownership - 01/13/2005First Reading January 13, 2005 Item No. 51 ORDINANCE NO. 2005-oo004 AN ORDINANCE ABANDONING AND CLOSING A P TION OF A 20-FOOT ALLEY LOCATED IN BLOCK 33, OVERTON ADD ON TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORD CE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAP F THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PRO~ lNG A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council fi ds that the alley portion as hereinafter described in the body of this Ordinance is no nger needed for public use and it would be in the public interest to close, vacate an abandon the same for alley purposes and for public use, and it would be in the pub · interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY T CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. T the alley portion as hereinafter described shall BE and the same is hereby clos , vacated and abandoned for alley purposes and for public use, such alley portion being ore particularly described as follows: All ofth east-west 20-foot alley from the east right-of-way line of Avenue T eas ard to an intersection with the east lot line of Lots 7 and 1 8 in Block 33, 0 rton Addition to the City of Lubbock, Lubbock County, Texas. SE TION 2. THAT the City Engineer is hereby authorized and directed to mark the offici 1 maps of the City of Lubbock to reflect said abandonment and closing, showing e number of this Ordinance and the date of its final passage. ECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word f this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of bbock is hereby authorized and directed to cause publication of the descriptive c 10n of this Ordinance as an alternative method provided by law. First Reading. BACKGROUND/DISCUSSION: This 20-foot by 300-foot alley portion in the Overton Addition is being closed as part of the McDougal North Overton redevelopment project for the new Wal-Mart. This alley area is located just east of Avenue T, between 4th Street and Sth Street. Since McDougal was not the original dedicator of this alley area being closed, there will be a charge for it. The total alley area being closed is 6,000 sq. ft. and the Right-of-Way Department has come up with a value of $1.50 per sq. ft. for this alley area. The value for the alley area being closed is $9,000 and since it will remain as an easement, the value will be discounted 50% for a total amount due the City of $4,500. , Lany HerteL City Engineer Agenda Items and Comments -City Council Meeting for January 13, 2005 Page 2 FISCAL IMP ACT: Income to the City of $4,500.00.
