AN ORDINANCE AMENDING·ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP
OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2118-L; A
ZONING CHANGE FROM R-1 SPECIFIC USE to C-2 AND GO ZONING ON A TRACT OUT OF
SECTION 15, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A
PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the
City Council finds that due to changed conditions, it would be expedient and
in the interest of the public health, morals, and general welfare to make
those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 29-29 of the Code of Ordi-
nances, City of Lubbock, Texas, as well as notices provided by Article
1011f, Vernon's Annotated Civil Statutes, and notice was duly published in
the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date
of the public hearing before the City Council on such proposed amendment,
and the public hearing according to said notice was duly held in the City
Council Room of the City Hall, Lubbock, Texas, at which time persons ap-
peared in support of the proposal; and, after said hearing, it was by the
City Council determined that it would be in the public interest, due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended
in the manner hereinafter set forth in the body of this Ordinance and this
Ordinance having been introduced prior to first reading hereof; NOW THERE-
FORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2118-L
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
A change of zoning from R-1 Specific Use to C-2 and GO zoning dis-
tricts, under provisions of Section 29-29 of the Code of Ordinances of
the City of Lubbock, on a tract of land out of Section 15, Block E-2,
City'of Lubbock, Lubbock County, Texas, located South of 82nd Street
and West of Vicksburg Avenue, subject to conditions and being further
described as follows:
TRACT 1
METES AND BOUNDS DESCRIPTION of a 3.18 acre tract located in Section
15, Block E-2, Lubbock County, Texas, being further described as fol-
lows:
BEGINNING at a point which bears East an approximate distance of 1060
feet and South an approximate distance of 55 feet from the Northwest
corner of Section 15, Block E-2, lubbock County, Texas;
THENCE East an approximate distance of 295 feet;
THENCE South an approximate distance of 150 feet;
THENCE Southwesterly around a curve to the left with an approximate
radius of 160 feet and an approximate chord distance of 110 feet;
THENCE South an approximate distance of 430 feet;
THENCE S. 75°30' W. an approximate distance of 93 feet;
THENCE West an approximate distance of 102 feet;
THENCE North an approximate distance of 638 feet to the POINT OF BE-
GINNING.
TRACT 2
METES AND BOUNDS DESCRIPTION of a 4.34 acre tract located in Section
15, Block E-2, lubbock County, Texas, being further described as fol-
lows:
BEGINNING at a point which bears East an approximate distance of 1355
feet and South an approximate distance of 55 feet from the Northwest
corner of Section 15, Block E-2, Lubbock County, Texas;
THENCE East an approximate distance of 337 feet;
THENCE South an approximate distance of 30 feet;
THENCE S. 19° W. an approximate distance of 482 feet;
THENCE S. 14°30' E. an approximate distance of 57 feet;
THENCE S. 75°30' W. an approximate distance of 307 feet;
THENCE North an approximate distance of 430 feet;
THENCE Northeasterly around a curve to the right with an approximate
radius of 160 feet and an approximate chord distance of 110 feet;
THENCE North an approximate distance of 150 feet to the POINT OF BE-
GINNING.
TRACT 3
METES AND BOUNDS DESCRIPTION of a 6.65 acre tract located in Section
15, Block E-2, lubbock County, Texas, being further described as fol-
lows:

BEGINNING at a point which bears East an approximate distance of 1692
feet and South an approximate distance of 55 feet from the ·Northwest
corner of Section 15, Block E-2, Lubbock County, Texas;
THENCE East an approximate distance of 423 feet to a point of curva-
ture;
THENCE Southeasterly around a curve to the right with a radius of 30
feet and a chord distance of 42.43 feet;
THENCE South an approximate distance of 220 feet;
THENCE S. 03° E. an approximate distance of 340 feet;
THENCE West an approximate distance of 225 feet;
THENCE North an approximate distance of 75 feet;
THENCE N. 85° W. an approximate distance of 225 feet;
THENCE S. 75°30' W. an approximate distance of 170 feet;
THENCE N. 14°30' W. an approximate distance of 57 feet;
THENCE N. 19° E. an approximate distance of 482 feet;
THENCE North an approximate distance of 30 feet to the POINT OF BEGIN-
NING.
SUBJECT TO THE FOLLOWING CONDITIONS:
a. That Tracts 1 and 2 shall be zoned C-2; and
b. That Tract 3 shall be zoned GO; and
c. That driveway entrances and sidewalks in the vicinity of the ex-
isting drainage easement be designed as depressed and be ap-
proved by the Engineering Department of the City; and
d. That the City Engineering Department shall review and approve
any raised landscape or parking feature that remains in the ul-
timate drainage easement; and
e. That a site plan, including building elevations showing materi-
als, color, and texture, shall be submitted and approved by the
Planning and Zoning Commission on Tract 1, prior to issuance of
a bui\ding permit; and
f. That a final site plan, including building elevations showing
materials, color and texture, shall be submitted and approved by
the Planning and Zoning Commission on Tract 2, prior to issuance
of a building permit.

SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed One Thousand Dol-
lars {$1,000.00) as provided in Section 29-31(a) of the Zoning Ordinance of
the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
