HomeMy WebLinkAboutOrdinance - 8981-1986 - Ordinance 8981 Altering Speed Limits On Certain Portions Of Indiana Avenue - 10/07/1986JWF:da First Reading October 7, 1986 Agenda I tern #18 Second Reading October 23, 1986 Agenda I Item #8 ORDINANCE NO • __ 8_9_81 __ _ AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ON CERTAIN PORTIONS OF INDIANA AVENUE, AS HEREINAFTER MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING PLACEMENT OF SIGNS WITH RESPECT THERETO; REPEALING CONFLICTING ORDINANCES TO THE EXTENT OF SUCH CONFLICT; APPLICATION OF THIS ORDINANCE ONLY TO STREETS OR HIGHWAYS NAMED HEREIN; PROVIDING THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock, upon the basis of an enqineerinq and traffic investiqation, finds it necessary to alter prima facie speed limits as established by Section 166(A)(l) of Article 670ld, Vernon's Annotated Civil Statutes, within the areas and the locations named and desiqnated in the body of this Ordinance, all within the corporate limits of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the prima facie speed limits on the followinq streets and hiqhways in the urban district set forth below are hereby altered and chanqed as hereinafter set forth upon the followinq described portions of streets and/or hiqhways located within the City of Lubbock, Lubbock county, Texas, to-wit: 1. A 45 M.P.H. speed zone on both sides of Indiana Avenue from 50th street to 82nd Street. 2. A 50 M.P.H. speed zone on both sides of Indiana Avenue from 82nd Street to the South city limits. SECTION 2. THAT all Ordinances or parts of Ordinances conflictinq with any of the provisions hereof are hereby re- pealed insofar as such conflict exists. j! , SECTION 3. THAT all hiqhways or streets not specifi- [i cally set forth in the precedinq sections hereof shall not be 11 affected by the provisions hereof, and this Ordinance shall be ], cumulative of all other prima facie speed limit Ordinances I: except those with which it specifically conflicts. SECTION 4. THAT the City Manaqer is hereby authorized and directed to cause the placinq and maintenance of such traffic control siqnals andjor devices andjor siqns as shall be necessary to apprise the public of the zones as hereinabove set forth. SECTION 5. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Code. SECTION 6. THAT should any paraqraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason the remainder of this Ordinance shall not be affected thereby. SECTION 7. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption and penalty clause of this Ordinance as an alternative method provided by law.
