HomeMy WebLinkAboutOrdinance - 8976-1986 - Ordinance 8976 Amending 7084 To Change: Case 1789-C - 09/25/1986LJM:da First Reading September 25, 1986 Agenda Item #11 Second Reading October 7, 1986 Agenda Item #10 ORDINANCE NO. 8976 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1789-C; A ZONING CHANGE FROM C-4 TO C-4 SPECIFIC USE PERMIT FOR MINI-WAREHOUSES ON A TRACT OUT OF SECTION 37, BLOCK A-K, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning com- mission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, as well as notices provided by Article lOllf, Vernon's Annotated Civil statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to I the date of the public hearing before the City council on such proposed amendment, and the public hearing according to said 1 notice was duly held in the City Council Room of the City ( Hall, Lubbock, Texas, at which time persons appeared in sup- 1 port of the proposal; and, after said hearing, it was by the . City Council determined that it would be in the public inter- ! . est, due to changed conditions, that the Zoning Ordinance and . the zoning Map be amended in the manner hereinafter set forth I. in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: I ~ li ~ r t' h p 'il I ij I; i! ~! ,! ~ ~ ~ . ~ i BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1789-C SECTION 1. THAT Ordinance No. 7084 and the Official Zon- ing Map BE and the same are hereby amended as follows, to-wit: A change of zoning from C-4 to C-4 Specific Use Permit, under provisions of Section 29-24(c){25) of the Code of Ordinances of the City of Lubbock for mini-warehouses, on a tract out of Section 37, Block A-K, City of Lubbock, Lubbock County, Texas, located at 4006 West Loop 289, subject to conditions and being further described as fol- lows: METES AND BOUNDS DESCRIPTION of an approximately 3.9 acre tract of land located in section 37, Block A-K, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears South an approximate distance of 2214.80 feet and West an approximate distance of 970.23 feet from the Northeast corner of section 37, Block A-K; THENCE West an approximate distance of 330.00 feet; THENCE North an approximate distance of 417.30 feet: THENCE East an approximate distance of 520.73 feet; THENCE s. 20•06 1 E. an approximate distance of 157.00. THENCE West an approximate distance of 245.00 feet; THENCE South an approximate distance of 272.30 feet to the POINT OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITION: a. That development shall be in compliance with the site plan presented. SECTION 2. THAT the Director of Planning of the city of Lubbock is authorized to issue a Specific Use Permit to the Applicant in said Zone case in accordance with the recommenda- tions and conditions imposed by the Planning and Zoning Com- mission, on file with the office of the Director of Planning and the City Council which are hereby adopted and incorporated herein by reference for all purposes, provided said applicant agrees to be bound by the term of the specific Use Permit, the granting of which is hereby made subject to compliance to all il provisions of Zoning Ordinance No. 7084, an ordinance of the :j City of Lubbock, including particularly, but not limited to .1 Section 29-24 of the Codified Zoning Ordinance, which provides " that a Specific Use Permit and a Building Permit shall be ap- plied for and secured within thirty (30) months of the effec- tive date of the zone change or all undeveloped property shal1 automatically revert back to the C-4 zoning district; and the Director of Planning in such event is directed to remove from the Zoning Map the legend indicating such limited use. The Specific Use authorized by this Ordinance is permitted under - 2 - provision of Section 29-24(c)(25) of Codified Zoning Ordinance No. 7084 on the property described as a tract out of Section 37, Block A-K, City of Lubbock, Lubbock County, Texas. SECTION 3. THAT violation of any provisions of this or- dinance shall be deemed a misdemeanor punishable by a fine not to exceed one thousand dollars as provided in Section 29-3l(a) of the Zoning Ordinance of the city of Lubbock. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordi- nance as an alternative method provided by law. AND IT IS SO ORDERED.
