HomeMy WebLinkAboutOrdinance - 8968-1986 - Ordinance 8968 Altering Speed Limits On Certain Portions Of East 50Th Street - 09/11/1986JWF:js First Reading September 11, 1986 Agenda Item #21 Second Reading September 25, 1986 Agenda Item #7 ORDINANCE NO. 8968 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ON CERTAIN PORTIONS OF EAST 50TH STREET, AS HEREINAFTER MORE PAR- TICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING PLACEMENT OF SIGNS WITH RESPECT THERETO; REPEALING CONFLICTING ORDINANCES TO THE EXTENT OF SUCH CONFLICT; APPLICATION OF THIS ORDINANCE ONLY TO STREETS OR HIGHWAYS NAMED HEREIN; PROVIDING THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A PENALTY; PRO- VIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock, upon the basis of an enqineerinq and traffic investiqation finds it necessary to alter prima facie speed limits as established by Section 166(A) (1) of Article 670ld, Vernon's Annotated Civil Statutes, within the areas and the locations named and desig- nated in the body of this Ordinance, all within the corporate limits of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the prima facie speed limits on the fol- lowinq streets and hiqhways in the urban district set forth below are hereby altered and chanqed as hereinafter set forth upon the following described portions of streets and/or high- ways located within the City of Lubbock, Lubbock county, Texas, to-wit: I . A 45 M.P.H. speed zone on both sides of East 50th street 1 from Avenue A to Southeast Drive. [! SECTION 2. THAT all Ordinances or parts of Ordinances 1; conflicting with any of the provisions hereof are hereby re- i' pealed insofar as such conflict exists. SECTION 3. THAT all hiqhways or streets not specifically set forth in the precedinq sections hereof shall not be af- fected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances ex- cept those with which is specifically conflicts. THAT violation of any provisions of this or- dinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Hundred Dollars ($200.00) as provided in Section 1-4 of the City Code. SECTION 6. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 7. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption and penalty clause of this Ordinance as an alternative method provided by law.
