JCR:da First Reading August 14, 1986 Agenda Item f/42 Second Reading August 28, 1986 Agenda Item #12 ORDINANCE NO. 8955 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE XVI OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK BY SPECIFICALLY AMENDING SECTION 2-412, SECTION 1, SUBSECTIONS (f), (q), (h), AND REPEALING SUBSECTION (i) OF SAID CHAPTER; PROVIDING FOR STAFF PERSONNEL FOR THE BOARD OF CITY DEVELOPMENT AND BY ADDING A NEW SECTION NUMBERED AS SECTION 2-423 OF SAID CHAPTER, WHICH SECTION ESTABLISHES RELATIONS BETWEEN THE BOARD OF CITY DEVELOPMENT AND ADMINISTRATIVE DEPARTMENTS OF THE CITY AND PROVIDING A SAVINGS CLAUSE. WHEREAS, the Board of City Development is created by Chapter 3, Article I of the Charter of the City of Lubbock; and WHEREAS, the Charter of the City of Lubbock allocates tax funds to the Board of City Development so that said Board may carry on its work~ and WHEREAS, the City Council is desirous of authorizing a competent and professional staff to assist the Board in the performance of its duties; and i 1 WHEREAS, the relationships between the Board of City ljl. Development and the Administrative Departments of the City need to be established upon a sound business basis; NOW '.1 THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: I! a !I i! SECTION 1. THAT Section 2-412, sec. 1, subsections (f), (q), (h) and (i) of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as follows: Section 2-412. Duties Generally (f) To assist the Board in the implementation of the lonq range economic development plan, the Board may, without approval of City Council, seek out and employ a Director of Economic Development. The Director of Economic Development shall be responsible to the Board and shall act as the Board's Chief Administrative Officer and shall assist the Board in carrying out the duties of the Board as set forth in Ordinance No. 8859 as amended. The Board shall, in the annual budget, make provisions for the compensation to be paid to the ~ I l ' Director of Economic Development and such compensation so established by the Board shall comprise the salary and benefits paid to the Director of Economic Development for his services. (q) The Director of Economic Development, consistent with the personnel policies and procedures adopted by the Board and set forth in the Board's rules, may, without approval of City Council, employ such other personnel as may be necessary in order to allow the Board to discharqe its assiqned duties. The compensation for all such employees shall be set by the Board in its annual budqet and such compensation so established by the Board shall comprise the salary and benefits for such employees and provided further no such employee shall be hired until such time as the Board has established such compensation for the position in question. (h) The Director of Economic Development shall serve at the pleasure of the Board and may be removed by the Board on an affirmative vote of three-fourths of the members of said Board votinq for such action. All other employees of the Board may be removed in accordance with personnel policies and procedures adopted by the Board and set forth in the Board's rules. (i) Subsection (i) is hereby repealed and shall be of no further force or effect. SECTION 2. THAT a new section, Section 2-423, be added to Chapter 2, Article XVI of the Code of Ordinances of the City of Lubbock, which new section reads as follows: Section 2-423. Board's relations with Administrative Departments of City Any request for services made to the Administrative Departments of the city shall be made by the Board in writinq to the City Manaqer. The City Manaqer may approve such request for assistance from the Board when he finds such requested services are available within the administrative departments of the City and that the Board has aqreed to reimburse the administrative department's budqet for the costs of such services so provided. SECTION 3. THAT should any section, paraqraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. -2- AND IT IS SO ORDERED.
