ORDINANCE NO. 8954 ------------
AN ORDINANCE AMENDING SECTION 28-151 OF THE LUBBOCK CITY
CODE TO PROVIDE FOR WATER AND SEWER SERVICE FROM STREETS,
WHERE THE CITY COUNCIL FINDS AN EXTREMELY UNHEALTHFUL
CONDITION: PROVIDING A SAVINGS CLAUSE: PROVIDING FOR
PUBLICATION AND DECLARING AN EMERGENCY.
WHEREAS, circumstances sometimes exist where alleys are
unavailable or insufficient for water and sewer service: and
WHEREAS, where an extremely ~nhealthful condition exists
the delays necessary to acquire alleys or comparable easements
would be contrary to the public interest: and
WHEREAS, streets may be an acceptable alternative in
cases where an extremely unhealthful condition exists: and
WHEREAS, an emergency exists concerning the safe, orderly
and healthful growth and development of the City in order to
assure the immediate preservation of the public peace,
property, health, safety and general welfare of the public
residing within the City and such emergency requires
suspension of the rule requiring that no Ordinance shall be
finally passed on the day of its introduction, and requires
that this Ordinance become effective immediately upon its
passage: NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 28-15l(a) of the Code of
Ordinances, City of Lubbock, Texas, is hereby amended to read
as follows:
11Sec. 28-151. Location for service connection.
(a) Water and/or sewer service shall only be provided to
property from dedicated alleys or comparable
easements except:
(1) in certain manufacturing zon~s where alleys or
easements were not required by the planning and
zoning commission; or
(2) where the City Council finds that in specific
locations, in order to avoid and eliminate
extremely unhealthful conditions which are
contributing factors to epidemics, it is the
express policy of the City Council, when
expressed by its resolution, to provide water
and sewer service from the street."
SECTION 2. THAT due to the fact that an emergency exists
concerning the safe, orderly and healthful growth and
development of the City in order to assure the immediate
preservation of the public peace, property, health, safety and
general welfare of the public within the City; therefore the
rule requiring that no Ordinance shall be finally passed on
the day of its introduction is hereby suspended and this
ordinance shall become effective immediately upon its passage,
as provided by the Charter of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional
or invalid for any reason, the remainder of this Ordinance
shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized
to cause publication of the descriptive caption of this
Ordinance as an alternative method provided by law.
