ORDINANCE NO. 8951
AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF AN ELEC-
TRIC LINE EASEMENT LOCATED IN SECTION 15, BLOCK A TO THE CITY
OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DE-
SCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY EN-
GINEER TO MARK THE OFFICIAL MAPS OF THE CITY OF LUBBOCK TO RE-
FLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS
CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that those portions of
the electric line easement as hereinafter described in the
body of this Ordinance are no longer needed for public use and
it would be in the public interest to close, vacate and aban-
don the same; and
WHEREAS, the Texas Department of Highways and Public
Transportation has agreed to reimburse the City of Lubbock for
the cost of relocating said easement; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT those portions of the electric line
easement as hereinafter described shall BE and the same are
hereby closed, vacated and abandoned for easement purposes and
for public use;
An electric line easement located in Section 15, Block A
to the City of Lubbock, Lubbock County, Texas, being fur-
ther described in three tracts as follows:
TRACT 1
BEING 26,814.63 square feet, more or less, of land out of
that certain tract of land situated in the City of
Lubbock, Lubbock County, Texas, being out of Lots 1
through 5, both inclusive, in Block 7, Country Club Addi-
tion, according to a map or plat of said Addition
recorded in Volume 155, Page 248 of the Deed Records of
Lubbock County, Texas; said tract being the same property
described in a Deed from John w. Cook and wife, Effie
Alice Cook, to John Sparling and wife, Thelma Juanita
Sparling, dated March 30, 1966, recorded in Volume 1081,
Page 62 of the Deed Records of Lubbock County, Texas;

said 26,814.63 square feet, more or less, beinq more par-
ticularly described by metes and bounds as follows:
BEGINNING at a point in the South riqht-of-way line of
Jarvis Street, said point beinq the Northwest corner of
said tract and 150.00 feet North 89.39 1 0111 West of the
Northeast corner of said tract7
THENCE South 87.39 101" East alonq the North line of said
tract a distance of 89.87 feet to a point in the proposed
East riqht-of-way line of IH 27:
THENCE South 02.52 1 12" East alonq the proposed East
riqht-of-way line of IH 27 a distance of 264.10 feet to a
point in the South line of said tract7
THENCE North 87.38 1 5911 West alonq the South line of said
tract a distance of 114.05 feet to the Southwest corner
of said tract;
THENCE North 02.22 1 5911 East alonq the West line of said
tract a distance of 263.00 feet to the POINT OF BEGIN-
NING.

BEING 216,206.58 square feet, more or less, of land out
of that certain tract of land situated in the City of
Lubbock, Lubbock County, Texas, beinq out Section 15,
Block A, conveyed to c. L. Adams by J. D. Slauqhter and
wife, Sammie Slauqhter, by Deed dated March 6, 1944, and
recorded in Volume 275, Paqe 186 of the Deed Records of
Lubbock County, Texas, and by Deed dated March 17, 1945,
and recorded in Volume 302, Paqe 128 of the Deed Records
of Lubbock County, Texas; where estate of c. L. Adams,
deceased; to Ann L. Adams and Larry c. Adams by Probate
Number 8735, filed May 26, 1965, where estate of Ann L.
Adams, deceased; to Larry c. Adams as his sole and sepa-
rate estate by Probate Number 21,883 and Deed dated
February 14, 1982, and recorded in Volume 1775, Paqe 337
of the Deed Records of Lubbock County, Texas, said
216,206.58 square feet, more or less, beinq more particu-
larly described by metes and bounds as follows:
BEGINNING at a point in the existinq West riqht-of-way of
Amarillo Hiqhway (U.S. 87) and the Northeast corner of
said tract, said point beinq North 87.39 1 22" West a dis-

the proposed West right-of-way of IH 27;
THENCE Northeasterly along said curve to the right, hav-
ing a radius of 739.30 feet and a radius bearing South
ss•ol'40" East, said curve being in the proposed West
right-of-way line, a distance of 464.60 feet to a point
in the proposed West right-of-way of IH 27;

right-of-way line of IH 27 a distance of 318.84 feet to a
point in the North line of said tract:
THENCE South 87.23 1 1611 East along the North line of said
tract a distance of 333.01 feet to the POINT OF BEGIN-

BEING 270,425.25 square feet, more or less, of land out
of that certain tract of land situated in the City of
Lubbock, Lubbock County, Texas, being out of Section 15,
Block A, conveyed to Brazos, Inc. by Ann L. Adams, a
widow, and Larry c. Adams by Deed dated January 5, 1978,
and recorded in Volume 1563, Page 241 of the Deed Records
of Lubbock County, Texas; said 270,425.25 square feet,
more or less, being more particularly described by metes and bounds as follows:
BEGINNING at a point in the existing East right-of-way of
Amarillo Highway (U.s. 87) and the Northwest corner of
said tract, said point being North 87.39 1 22 11 West a dis-

tract a distance of 370.61 feet to a point at the South-
west corner of said tract;

SECTION 2. THAT the City Enqineer shall mark the offi-
cial maps of the City to indicate said abandoninq and closinq,
showinq the number of this Ordinance and the date of its final passaqe.
SECTION 3. THAT should any section, paraqraph, sentence,
phrase, clause or word of this ordinance be declared unconsti-
tutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.

SECTION 4. THAT the City Secretary is hereby authorized
and directed to cause publication of the descriptive caption
of this Ordinance as an alternative method provided by law.
