ORDINANCE NO. 8948
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING'
CHANGES: ZONE CASE NO. 2460-C: A ZONING CHANGE FROM R-1
SPECIFIC USE, C-2A, C-2A SPECIFIC USE, C-2, C-2 SPECIFIC USE,
AND C-3 SPECIFIC USE TO R-1, C-2, C-2 LIMITED TO PROFESSIONAL
OFFICES, C-3 AND GO ZONES AND R-1 SPECIFIC USE PERMIT FOR
TOWNHOUSES/GARDENHOMES ON A TRACT OUT OF SECTION 11, BLOCK E-
2, LUBBOCK, TEXAS: SUBJECT TO CONDITIONS; PROVIDING A PENALTY;
PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed chanqes in zoninq as hereinafter
made have been duly presented to the Planninq and Zoninq
Commission for its recommendation which was received by the
City Council and, after due consideration, the City Council
finds that due to chanqed conditions, it would be expedient
and in the interest of the public health, morals, and qeneral
welfare to make those proposed chanqes in zoninq; and
WHEREAS, all conditions precedent required by law for a
valid amendment to the Zoninq Ordinance and Map have been
fully complied with, as well as qivinq notices in compliance
with Section 29-29 of the Code of Ordinances, City of Lubbock,
Texas, as well as notices provided by Article lOllf, Vernon's
Annotated Civil Statutes, and notice was duly published in the
Lubbock Avalanche-Journal more than fifteen (15) days prior to
the date of the public hearinq before the City Council on such
proposed amendment, and the public hearinq accordinq to said
notice was duly held in the City Council Room of the City
Hall, Lubbock, Texas, at which time persons appeared in
support of the proposal; and, after said hearinq, it was by
the City Council determined that it would be in the public

interest, due to chanqed conditions, that the zoninq Ordinance

and the Zoninq Map be amended in the manner hereinafter set

SECTION 1. THAT Ordinance No. 7084 and the Official
Zoninq Map BE and the same are hereby amended as follows, to-
wit:
A change of zoning from R-1 Specific Use, C-2A, C-2A
Specific Use, c-2, c-2 Specific Use, and C-3 Specific Use
to R-1, c-2, c-2 limited to professional offices, C-3,
and GO zone districts, and R-1 Specific Use Permit, under
provisions of Section 29-24(c)(2) of the Code of
Ordinances of the City of Lubbock for townhouses/
gardenhomes, on a tract of land out of Section 11, Block
E-2, City of Lubbock, Lubbock County, Texas, located at
the Southeast corner of s. Loop 289 and Quaker Avenue,
subject to conditions and being further described as

Avenue between the alley north of 75th Street and
the alley south of 78th Street, shall be zoned GO
and that they must be developed prior to or
concurrent with the development of Tracts H and JJ

h. That a site plan, including building elevations
showing materials, color, and texture shall be
submitted and approved by the Planning and Zoning
Commission on the entire tract under this zoning
ordinance, prior to issuance of a building permit.
SECTION 2. THAT the Director of Planning of the City of
Lubbock is authorized to issue a Specific Use Permit to the
Applicant in said Zone Case in accordance with the
recommendations and conditions imposed by the Planning and
zoning commission, on file with the office of the Director of
Planning and the City Council which are hereby adopted and
incorporated herein by reference for all purposes, provided
said applicant agrees to be bound by the term of the Specific
Use Permit, the granting of which is hereby made subject to
compliance to all provisions of Zoning Ordinance No. 7084, an
Ordinance of the City of Lubbock, including particularly, but
not limited to Section 29-24 of the Codified Zoning Ordinance,
which provides that a Specific Use Permit and a Building
Permit shall be applied for and secured within thirty (30)
months of the effective date of the zone change or all
1 undeveloped property shall automatically revert back to the
R-1 and C-3 zone districts as set out in Ordinance No. 2127-B;
j and the Director of Planning in such event is directed to

the purposes of this ordinance, out of Section 11, Block E-2,
City of Lubbock, Lubbock County, Texas.
SECTION 3. THAT violation of any provisions of this
ordinance shall be deemed a misdemeanor punishable by a fine

not to exceed one thousand dollars as provided in Section 29-
31(a) of the Zoninq Ordinance of the City of Lubbock.
SECTION 4. THAT should any paraqraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional
or invalid for any reason, the remainder of this Ordinance
shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized
to cause publication of the descriptive caption of this ·
ordinance as an alternative method provided by law.
