ORDINANCE NO. 8946
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING
CHANGES: ZONE CASE NO. 2570; A ZONING CHANGE FROM T TO M-1
ZONING ON A TRACT OUT OF SECTION 9, BLOCK E, LUBBOCK, TEXAS;
SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A
SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter
made have been duly presented to the Planning and Zoning
Commission for its recommendation which was received by the
City council and, after due consideration, the City Council
finds that due to changed conditions, it would be expedient
and in the interest of the public health, morals, and general
welfare to make those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a
valid amendment to the zoning Ordinance and Map have been
fully complied with, as well as giving notices in compliance
with Section 29-29 of the Code of Ordinances, City of Lubbock,
Texas, as well as notices provided by Article 1011f, Vernon's
Annotated Civil statutes, and notice was duly published in the
Lubbock Avalanche-Journal more than fifteen (15) days prior to
the date of the public hearing before the City Council on such
proposed amendment, and the public hearing according to said
notice was duly held in the City council Room of the City
Hall, Lubbock, Texas, at which time persons appeared in
support of the proposal; and, after said hearing, it was by
the City Council determined that it would be in the public
interest, due to changed conditions, that the Zoning Ordinance
and the Zoning Map be amended in the manner hereinafter set
forth in the body of this Ordinance and this Ordinance having
been introduced prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2570
SECTION 1. THAT Ordinance No. 7084 and the Official
·zoning Map BE and the same are hereby amended as follows, to-
wit:
A change of zoning from T to M-1 zoning district, under
provisions of Section 29-29 of the Code of Ordinances of
the City of Lubbock, on a tract out of Section 9, Block

E, City of Lubbock, Lubbock county, Texas, located on the
Southwest corner of 84th Street and Avenue P, subject to
conditions and being further described as follows:
A tract of land out of the Northeast 1/4 of Section 9,
Block E, Lubbock County, Texas, described as follows, to-
wit:
BEGINNING at a 5/811 iron rod with cap, found in the South
line of a 60.0 feet Street (Volume 1761, Page 129) for
the Northwest corner of this tract, from whence the
Northeast corner of Section 9, Block E, bears North,
750.0 feet and North, 89.57'0011 East, 340.0 feet;
THENCE South, a distance of 497.58 feet to a 5/8" iron
rod with cap, found for the Southwest corner of this
tract;
THENCE North 89.57 1 0011 East, at 310.0 feet pass a 1/211
iron rod, set in West line of Avenue P, continuing for a
total distance of 340.0 feet to a railroad spike, set for
the Southeast corner of this tract:
THENCE North, a distance of 497.58 feet to a point for
the Northeast corner of this tract:
THENCE South 89.57'0011 West, at 30.0 feet pass 1/2" iron
rod, set in West line of Avenue P and the south line of a
60.0 foot street, continuing for a total distance of
340.0 feet to the PLACE OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:

That a 7' solid screening fence shall be required to
be installed surrounding any outside storage; and
That 5% landscaping shall be required between the
setback lines and the streets.
[I SECTION 2. THAT violation of any provisions of this
lr Ordinance shall be deemed a misdemeanor punishable by a fine ll not to exceed one thousand dollars as provided in section 29-
'l 31 (a) of the Zoning Ordinance of the City of Lubbock.
c SECTION 3. THAT should any paragraph, sentence, clause,
[j phrase or word of this ordinance be declared unconstitutional
il lj or invalid for any reason, the remainder of this Ordinance

SECTION 4. THAT the City Secretary is hereby authorized
to cause publication of the descriptive caption of this
Ordinance as an alternative method provided by law.
AND IT IS SO ORDERED.
