HomeMy WebLinkAboutOrdinance - 2011-O0085 - Amending Chapter 1 Code Of Ordinances Voting Districts - 09/08/2011First Reading September 8, 2011 Item No. 5.27 ORDINANCE NO. 2011-00085 Second Reading September 27, 2011 Item No. 5.15 AN ORDINANCE AMENDING CHAPTER 1 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING THE LANGUAGE OF SECTION l.02.004(b) and (c) WITH REGARD TO ESTABLISHMENT OF VOTING DISTRICTS FOR CITY COUNCIL MEMBERS BASED UPON THE 2010 FEDERAL CENSUS; PROVIDING A MAP OF THE VOTING PRECINCTS AND DISTRICTS OF THE CITY OF LUBBOCK; PROVIDING THAT ALL PORTIONS OF CHAPTER 1 NOT AMENDED SHALL REMAIN THE SAME; PROVIDING A SA VINOS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE AND IMPLEMENTATION. WHEREAS, the City Council of the City of Lubbock has received the results of the 2010 federal census and has studied such results itself and by means of a Redistricting Advisory Committee; and WHEREAS, seven (7) public hearings were conducted on various plans for redistricting on May I, 2011, May 2, 2011, May 11, 2011, May 12, 2011, May 15, 2011, May 16, 2011 and June 21, 2011; and WHEREAS, the City Council after due consideration of the recommendation of the Redistricting Advisory Committee and other information provided by the staff, consultants and the public has determined that it would be in the best interest of the citizens of the City of Lubbock to require that the following changes be made to the City Council Voting Districts in keeping with the requirements of the Voting Rights Act of 1965, as amended, and the judgment rendered in Jones v. City of Lubbock, No. 79-2744, Northern District of Texas; and WHEREAS, Section 276.006 of the Election Code states that any change to election district boundaries from which an officer is elected shall not be effective until three (3) months from the date of final approval of the change; and WHEREAS, this ordinance shall not be implemented until such time as final approval is obtained from the U.S. Department of Justice as required by federal law; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Subsection 1.02.004(b) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows with regard to the following named City Council voting districts: Voting District No. 1: Precinct Nos. l, 2, 3, 4, 5, 8, IO, 17, 18, 19, and 114. Voting District No. 2: Precinct Nos. 6, 20, 24, 25, 26, 29, 40, 118, and 119. Voting District No. 3: Precinct Nos. 13, 14, 15, 16, 21, 22, 23, 27, 28, 49, and 50. Voting District No. 4: Precinct Nos. 12, 30, 52, 54, 60, 67, 75, 109, 122, 123, 126, 127, 133, 136, and 137. Voting District No. 5: Precinct Nos. 7, 57, 62, 66, 78, 96, 104, 110,111,112,115,116,124,125,128,129, 134,and 138. Voting District No. 6: Precinct Nos. 9, 47, 53, 58, 59, 63, 72, 76, 92, 113, 130, 131, and 135. SECTION 2. THAT subsection l.02.004(c) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (c) The voting districts, voting precincts and voting places set out in this section are hereby delineated on the map denominated "City of Lubbock Voting Precincts/Districts/Adopted September 8, 2011/Official Map." A copy of said map is attached and made a part of this section as if fully copied herein in detail. A copy of the original of such map shall be kept in the office of the City Secretary and shall be available for public inspection, and at each special and general city election, a true copy of said map shall be furnished by the City Secretary to each of the presiding judges of the voting precincts for such special or general city election. SECTION 3. THAT all portions of Chapter 1 of the Code of Ordinances not amended by this Ordinance shall remain the same. SECTION 4. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of this Ordinance in its entirety in both English and Spanish languages following final passage by the City Council. SECTION 6. THAT this Ordinance shall be effective upon final passage but hall not be implemented for any election conducted by the City of Lubbock for three (3) onths following final passage by the City Council upon second reading in accordance ·th Section 276.006 of the Election Code and until such time as approval to implement said changes in voting practices and procedures is obtained from the U.S .
