HomeMy WebLinkAboutOrdinance - 6403-1972 - Amending Ch. 34 "Water, Sewers And Sewage Disposal" - 06/22/1972,; '-" KJ:pr ORDINANCE NO. 6403 AN ORDlliANCE AMENDING CHAPTER 34, ENTITLED "WATER, SEWERS AND SEWAGE DISPOSAL 11, OF THE CODE OF ORDINANCES., CITY OF LUBBOC1r• BY AMENDING SECTION 34-2 THEREOF ESTABLISHING A WATER RESOURCE BOARD: AMENDING SECTION 34-3 SETTING TERMS OF BOARD MEMBERS; AMENDING SECTION 34-4 PROVIDING FOR FILLING VACANCIES ON BOARD; REPEALING SECTION 34-6: AMENDING SECTION 34-9 PROVIDING FOR EX-OFFICIO MEMBERS; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council has determined that the changes indicated belo in the establishment and operation of the Water Resource Board of the City of Lubbock, would be in the best interest of the citizens of the City of Lubbock; NOW1 THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 34-2 of Chapter 34 of the Code of Ordinances, City of Lubbock~ BE and is hereby amended to read as follows: ''Section 34-2. Water Resource Board There is hereby created and established an advisory water resource board to be composed of seven members, each of whom shall be resident citizens of the City at the time of his appointment and during his term of office. The official designation of such board shall be the "Water Resource Board''. " SECTION 2. THAT Section 34-3 of Chapter 34 of the Code of Ordinances, City of Lubbock, BE and is hereby amended to read as follows: "Section 34-3. Same-Term of members. The members of the Water Resource Board shall be appointed by the City Council and shall serve for the duration of term of such board as established by the City Council. The City Council may activate the Water Resource Board at any time it deems necessary and may establish the term of activity at any number of days or months or .,. ___ ----1-.a..:---.C ----.J--!----L--1 --·--~.--A.-.... -L·-·, ,......,,_._ • v Water Resource Board, the City Council shall appoint a successor to fill such vacancy and such successor shall serve for the remainder of the Board's term. " SECTION 4. THAT Section 34-6 of Chapter 34 of the Code of Ordinances,. City of Lubbock, BE and is hereby repealed. SECTION 5. THAT Section 34-9 of Chapter 34 of the Code of Ordinances,. City of Lubbock, BE and is hereby amended to read as follows: "Section 34-9. Same -Ex-Officio members. A member of the City Council, selected by the City Council,. along with the City Manager and the Director of Public Works shall serve as ex-officio members of the Water Resource Board1 without voting privileges, and shall act in an advisory and liason capacity to such board. 11 SECTION 6. THAT should any section, paragraph, sentence, clause, phras or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 7. THAT the City Secretary is hereby authorized to cause publi-cation of the descriptive caption of this Ordinance as an alternative method provid by law. AND IT IS SO ORDERED.
