WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to amend Section 34B of Ordinance No. 8554 relating to sales, repair and installation of equipment by cable television franchise grantees in order to provide greater clarity; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: SECTION 1. THAT Section 348 of Ordinance No. 8554 BE and is hereby amended to read as follows: "B. No Grantee nor any representative of a Grantee shall engage in the business of selling, repairing or installing television receivers, radio receivers, or accessories necessary for the actual operation of such receivers within the City of Lubbock during the term of a franchise, and the Grantee shall not allow any of its share- holders to engage in any such business." SECTION 2. THAT violation of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Hundred Dollars ($200.00). SECTION 3. THAT if any section, sentence, clause, phrase or word of li this Ordinance is held unconstitutional or otherwise invalid, such in- ;11,.~ formity shall not affect the validity of this Ordinance, and any portions 1 in conflict are hereby repealed. Provided, however, that in the event that H the state or federal government laws or regulations render any section 1! invalid, then such section may be renegotiated by the City and a company. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law. • AND IT IS SO ORDERED.
