HomeMy WebLinkAboutOrdinance - 8922-1986 - Ordinance 8922; Change Case No. 2216-B - 05/22/1986LJM:js Fi-rst Reading r~ay 22, 1986 Agenda Item #8 Second Reading June 12, 1986 Agenda Item #7 ORDINANCE NO. 8922 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OffiCIAL MAP Of THE CITY Of LUBBOCK MAKING THE fOLLOWING CHANGES: ZONE CASE NO. 2216-B; A ZONING CHANGE fROM R-1 SPECifiC USE TO C-3 ZONING, ON LOT 1-A AND PART Of LOT 2-A, KFYO ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING fOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordin- ances, City of Lubbock, Texas, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREfORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: ZONE CASE NO. 2216-B SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from R-1 Specific Use to C-3 zoning district, under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on Lot 1-A and part of Lot 2-A, KFYO Addition, City of Lubbock, Lubbock County, Texas, located at 82nd Street and 400' east of Quaker Avenue and subject to conditions, and being further described as follows: METES AND BOUNDS DESCRIPTION for all of Lot 1-A and a portion of Lot 2-A, a replat of Lots 1 and 2, KfYO Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at the Southwest corner of said Lot 1-A, KfYO Addition, said point bears N. 89°59'40" E. a distance of 206.00 feet and N. 00°02'4611 E. a distance of 65.00 feet from the Southwest corner of Section 11, Block E-2, Lubbock County, Texas; THENCE N. 00°02'4611 E. a distance of 218.50 feet; THENCE N. 89°59'40" E. a distance of 72.55 feet; THENCE N. 00°02'46" E. a distance of 50.00 feet; THENCE N. 89°59'40" E. a distance of 720.00 feet; THENCE N. 00°02'46" E. a distance of 210.00 feet; THENCE N. 89°59'40" E. a distance of 551.46 feet; THENCE s. 00°02'46" w. a distance of 488.50 feet; THENCE S. 89°59'4011 w. a distance of 1037.00 feet; THENCE N. 87°08'35" w. a distance of 200.25 feet; THENCE S. 89°59'40" w. a distance of 107.00 feet to the POINT Of BEGINNING. SUBJECT TO THE fOLLOWING CONDITION: a. That a site plan, including building elevations showing materials, color, and texture, shall be submitted and approved by the Planning and Zoning Commission on the entire tract under this zoning ordinance prior to the issuance of a building permit. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed one thousand dollars as provided in Section 29-31(a) of the Zoning Ordinance of the City of Lubbock. · SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 2 - SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
