First Reading March 13, 1986 Agenda Item #18il Second Reading March 27, 1986 Agenda Item #6 DGV:sl ORDINANCE NO. 8901 AN ORDINANCE AMENDING CHAPTER 12 or THE CODE Or ORDINANCES or THE CITY Or LUBBOCK, TEXAS, WITH REGARD TO PERMIT fEE AMOUNTS fOR fOOD PROCESSING ESTABLISHMENTS SUBJECT TO DAILY fEDERAL OR STATE INSPECTION; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING fOR PUBLICATION. WHEREAS, many food processing establishments located within the City of lubbock are subject to daily inspections by another governmental entity, such as the USDA or the Texas Health Department; and WHEREAS, such daily inspections reduce the need for City of lubbock inspections on a frequent basis; and WHEREAS, the City Council deems it to be in the best interest of the citizens of the City of lubbock to reduce the permit fee amount paid by such establishments due to the reduced inspection requirement; NOW THEREfORE: BE IT ORDAINED BY THE CITY COUNCIL or THE CITY or LUBBOCK: SECTION 1. THAT Sec. 12-27 of the Code of Ordinances of the City of lubbock BE and is hereby amended by adding thereto a new subsection (5) which shall read as follows: (5) If the application is for a food processing establishment, it shall also state whether such establishment is subject to a daily inspection schedule by federal or state authorities. SECTION 2. THAT Sec. 12-29, Subsection (2), of the Code of Ordinances of the City of lubbock BE and is hereby amended to read as follows: (2) rood processing permit: Square footage 0-1000 •••••••••••••• 45.00 Square footage 1001-3000 ••••••••••• 60.00 Square footage 3001-5000 ••••••••••• 75.00 Square footage 5001-10,000 ••••••••• 90.00 Square footage over 10,000 •••••••• 105.00 rood processing establishments subject to daily inspection by federal or state authorities shall pay one quarter of the amounts specified above, rounded to the nearest dollar. SECTION 3. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine as provided by law. .. / SECTION 4. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
