HomeMy WebLinkAboutOrdinance - 8897-1986 - Ordinance 8897 Amending Ordinance 8892, Wording Proposiiton 19 - 02/27/1986' "' -., DGV:cl First Reading February 27, 1986 Agenda Item #21-A (Emergency) ORDINANCE NO. 8897 AN ORDINANCE AMENDING ORDINANCE NO. 8892 CALLING A CHARTER AMENDMENT ELECTION FOR APRIL 5, 1986, AND ESTABLISHING THE WORDING OF AMENDMENTS TO BE CONSIDERED; ALTERING THE WORDING OF PROPOSITION NO. 19 PERTAINING TO QUALIFICATIONS FOR CANDIDACY FOR CITY OFFICE; REQUIRING PUBLICATION OF THIS AMENDMENT; AND DECLARING AN EMERGENCY. WHEREAS, it has been learned that the proposed wording of Proposition No. 19 of Ordinance 8892 would place the City Charter in conflict with Sec. 143.005(c) of the new Texas Election Code; and WHEREAS, it is in the best interest of the citizens of the City of Lubbock to correct such wording so that proper wording appears on the ballot for the April 5, 1986, City Charter Election; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Proposition 19 of Ordinance No. 8892 BE and is hereby amended to read as follows: PROPOSITION NO. 19 "SHALL the Charter of the City of Lubbock be amended to provide for a One Hundred Dollar ($100.00) filing fee or a 25 signature Petition for Candidacy for all City elected positions." In the event of approval of such proposition, Chapter 1, Article IX, Section 5, paragraph "Candidates; official ballot" shall be amended to read as follows: "Candidates; official ballot; filing fee; petition. Each candidate for a City elective office shall request in writing to have his or her name placed upon the official ballot, which request shall be filed along with the appropriate filing fee or a Petition for Candidacy with the person exercising the duties of City Secretary at least thirty (30) days before the upcoming election. Candidates for Councilmember shall indicate upon their written request in which District he or she desires to become a candidate. The filing fee shall be One Hundred Dollars ($100.00) for all positions and a Petition for Candidacy filed in lieu of s filing fee shall be signed by not less than twenty-five (25) qualified voters of the applicable district or area of the particular candidate." ... ··-Jt SECTION 2. THAT the City Secretary is hereby authorized and directed to publish this amendment along with all required publication of the Ordinance calling the April 5, 1986, Charter Amendment Election. SECTION 3. THAT this ordinance be passed upon the day of its intro- duction as an emergency measure due to the fact that such change must be included in all required election publications and the change completed in time to be placed on the ballot with the proper wording.
