HomeMy WebLinkAboutOrdinance - 2011-O0042 - Amending Chapter 28 (Building Regulations) - 05/10/2011First Reading May 10, 2011 Item No. 5.13 ORDINANCE NO. 2011-00042 ------- Second Reading May 31, 2011 Item No. 5.15 AN ORDINANCE AMENDING CHAPTER 28 (BUILDING REGULATIONS) OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO REPEALING OUTDATED AND UNNECESSARY PROVISIONS, AMENDING PROVISIONS TO ENCOMPASS CURRENT PRACTICES, AND CONFORMING THE ORDINANCE TO THE STANDARDS AND CONVENTIONS OF THE REST OF THE CODE OF ORDINANCES; PROVIDING A SA VIN GS CLAUSE; PROVIDING A PENAL TY CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock, Texas finds and detennines that it is in the best interest of the citizens of the City of Lubbock to make the following amendments to Chapter 28 (Building Regulations) of the Code of Ordinances of the City of Lubbock; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT, Section 28.04.007 of the Code of Ordinances, City of Lubbock, Texas be amended to read as follows: Sec. 28.04.007 Expiration (a) Registrations shall expire December 31 of each year and must be renewed annually in order to obtain pennits or to continue work pursuant to active pennits. (b) Failure to keep proper bonds or insurance in force will result in automatic tennination of registration and will invalidate any active pennits. In order to reinstate registration and any active pennits, all fees, including registration and pennit fees, must again be paid as for an initial application. SECTION 2. THAT, Section 28.05.009 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: Sec. 28.05.009 Phased approval The building official is authorized to issue a pennit for the construction of foundations or any other part of a building or structure before the construction documents for the whole building or structure have been approvecl, provided that adequate information and detailed statements have been filed complying with pertinent requirements of this code. The holder of such pennit for the foundation or other parts of a building or structure shall proceed at the holder's own risk and , without assurance that a pennit for the entire structure will be granted. SECTION 3. THAT, Section 28.05.022(b) of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: Q:\CCDOCS\Ordinance -000_ (Ch 28 -Building Regulations FINAL).doc Sec. 28.05.022 Transferring of permit (b) In every case where the building official determines that a new permit will be issued to a new contractor, and the scope of the work remains unchanged from that covered by the original permit, the person requiring such permit shall pay a transfer fee of two hundred fifty dollars ($250.00), but in no case more than the fee for the original permit, and no refund shall ever be made on the original permit issued. Where the scope of the work has or will be changed such that a new plan review is necessary, the fee for the reissued permit shall be the same as that for a new project. SECTION 4. THAT, Section 28.05.061 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: Sec. 28.05.061 Work exempt from permit Exemptions from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Where determined by the building official, permits may be waived for small and unimportant work, and as set forth in Sections 28.05.062 through 28.05.068 of this Division. SECTION 5. THAT, Section 28.05.103 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: Sec. 28.05.103 New construction permit fees (a) One-and two-family dwellings. Building permit fees shall be seven cents ($0.07) per square foot of gross building area under roof, inclusive of all stories but excluding unheated attached garages and covered porch or balcony areas. Building permit fees for detached accessory buildings associated with one-and two-family dwellings shall be ten cents ($0.10) per square foot of gross building area under roof, including unheated areas. Building permit fees for additions to existing floor area shall be as for new construction except that the gross floor area of the addition alone shall be used to determine appropriate fees. The minimum fee shall be $30.00; however, where more than one inspection is required an additional fee of $15.00 shall be assessed for each such additional inspection. SECTION 6. THAT, Section 28.09.041 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: Sec. 28.09.041 requirements Construction documents; specific submittal 2 No Text ✓ In addition to submittal requirements specified in section 28.05, Division 1 of this code, the documentation described in Sections 28.09.042 through 28.09.046 of this Code shall be submitted, as applicable. SECTION 7. THAT, Section 28.10.002 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: Sec. 28.10.002 Coordination of administrative provisions The administrative provisions contained in chapter 28, articles 28.01 through 28.08 of this Code of Ordinances are applicable to this article; however, for purposes of administering provisions related more specifically to the regulation of plumbing systems installation, these supplemental administrative provisions have been provided. Except as amended or supplemented within sections 28.10.002, 28.10.003, and 28.10.051 through 28.10.056, the entire text of chapter 1 of the 2006 International Plumbing Code is deemed to be incorporated herein as though set out herein in detail. Where a conflict arises between a provision contained within sections 28.10.002, 28. 10.003, and 28.10.051 through 28.10.056 and articles 28.01 through 28.08 of this Code of Ordinances, it is the intent that the more specific shall govern, as determined by the building official. SECTION 8. SECTION 10. THAT, Section 28.16.002 of the Code of Ordinances, City of Lubbock, Texas is hereby renumbered and amended to read as follows: Sec. 28.16.003 Supplemental administrative Amendments (a) Title. Section 101.1 is hereby amended to read as follows: 101.1 Title. This code shall be known as the International Energy Conservation Code of the City of Lubbock, Texas and shall be cited as such. It is referred to herein as "this code." (b) Exempt buildings. Section 101.4. l shall be amended to read as follows: IO 1.4.1 Exempt buildings. Buildings and structures indicated in sections IO 1.4.1.1 and IO 1.4.1.2 and IO 1.4.1.3 shall be exempt from the provisions of this code. Commercial buildings provided with service water heating and/or electric lighting shall meet the applicable provisions of chapter 7 or 8 regardless of this exempt status. 6 {c) Hospitals and research laboratories. Section 101.4.1 shall be amended by adding a new subsection IO 1.4.1.3 to read as follows: l O 1.4. l.3 Hospitals and research laboratories. Hospitals that are licensed by the Texas Department of State Health Services shall be exempt from the provisions of this code. Research laboratory buildings containing fume hoods and other HY AC systems for the protection of occupants shall be exempt from the provisions of this code. {a) Exterior design conditions. Amend the third paragraph of subsection 503.3.2.2 to read as follows: Where used to control both comfort heating and cooling, thennostatic controls shall be capable of providing a temperature range or dead band of at least 2°F within which the supply of heating and cooling energy is shut off or reduced to a minimum. {D 503.3.3.1 Piping insulation. Amend the first paragraph of subsection 503.3.3.1 to read as follows: All HV AC refrigerant system piping shall be insulated with 3/8 inch wall closed cell insulation. All HV AC heating system piping shall be thermally insulated in accordance with Table 503.3.3.1. {k) Minimum duct insulation. (r) Set point overlap restriction. Amend subsection 803.3.3.2 to read as follows: Where used to control both heating and cooling, zone thermostatic controls shall provide a temperature range or deadband of at least 2°F within which the supply of heating and cooling energy to the zone is capable of being shut off or reduced to a minimum. SECTION 11. THAT, Section 28.16.002 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: Sec. 28.16.002 Coordination of administrative provisions The administrative provisions contained in chapter 28, articles 28.0 l through 28.08 of this Code of Ordinances are applicable to this article; however, for purposes of administering provisions related more specifically to the regulation of building energy conservation systems, these supplemental administrative provisions have been provided. Except as amended or supplemented within section 28.16.003, the entire text of chapter l of the 2000 International Energy Conservation Code is deemed to be incorporated herein as though set out herein in detail. Where a conflict arises between a provision contained within section 28.16.003 and chapter 28, articles 28.0 l through 28.08 of this Code of Ordinances, it is the intent that the more specific govern, as determined by the building official. SECTION 12. THAT, unless otherwise provided herein, a violation of any provision of this Ordinance shall be deemed a misdemeanor punishable as provided by Section 1.01.004 of the Code of Ordinances of the City of Lubbock. SECTION 13. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 14. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. 10 SECTION 15.
