I I WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the · City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordin- ances, City of Lubbock, Texas, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date 1 of the public hearing before the City Council on such proposed amendment, 1 and the public hearing according to said notice was duly held in the City I' Council Room of the City Hall, Lubbock, Texas, at which time persons . appeared in support of the proposal; and, after said hearing, it was by the I City Council determined that it would be in the public interest, due to 11 changed conditions, that the Zoning Ordinance and the Zoning Map be amended 1! in the manner hereinafter set forth in the body of this Ordinance and this !i Ordinance having been introduced prior to first reading hereof; NOW j1 THEREFORE: i! .. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO •. 2554 SECTION 1. THAT Ordinance No. 70B4 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from T to M-2 zoning district, limited to: 1) concrete products manufacturing and 2) uses unconditionally permitted in the M-1 zoning district, under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on a tract of land out of Section 39, Block A-K, Lubbock County, Texas, located at 34th Street and Wausau Avenue, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION for an 8.346 acre tract of land in the Northeast Quarter of Section 39, Block A-K, G.C. & S.F. R.R. Co. Survey, Lubbock County, Texas, being further described as follows: BEGINNING at a 3/B" iron rod with cap found in the North line of said Section 39 at the Northwest corner of Northeast Quarter of Section 39; THENCE S. 00°05'5011 W. a distance of 494.31 feet to a point in the Northeast right-of-way line of the P. & S.F. Railroad; THENCE S. 72°07' E., along said railroad right-of-way line, a distance of 585 feet to a point; THENCE East 125' to a point; THENCE N. 00°05'5011 E. a distance of 660 feet to a point in the North line of Section 39; THENCE West, along the North line of Section 39, a distance of 675' to the Point of Beginning. SUBJECT TO THE FOLLOWING CONDITION: a. That the M-2 zoning be limited to: 1) Concrete products manufacturing; and 2) Uses unconditionally permitted in the M-1 zoning district. ;1 )j SECTION 2. THAT violation of any provisions of this Ordinance shall !I be deemed a misdemeanor punishable by a fine not to exceed the limits ill. provided in Section 29-31(a) of the Zoning Ordinance of the City of :I Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. - 2 - AND IT IS SO ORDERED.
