" LJM:da First Reading January 23, 1986 Agenda Item #22 Second Reading February 13, 1986 Agenda Item #12 ORDINANCE NO. _8_8_87 __ AN ORDINANCE AMENDING ZONI~G ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 1895-A; A CHANGE OF ZONING FROM C-2 SPECIFIC USE TO C-2 UNDER PROVISIONS OF SECTfQN 29-29 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, ON A TRACT OF LAND OUT OF SECTIONS 10 AND 11, BLOCK E-2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 29-31(a) OF THE ZONING ORDINANCE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordin- ances, City of Lubbock, Texas, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1895-A SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from C-2 Specific Use to C-2 under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on a tract of land out of Sections 10 and 11, Black E-2, City of Lubbock, Lubbock County, Texas, located at the southeast corner of Loop 289 and Quaker Avenue, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION of a 346,302.00 square feet tract located in Sections 10 and 11, Block E-2, Lubbock County, Texas, being further described as follows: BEGINNING at a found 1/211 iron rod which bears N. 00°02'46" E. a distance of 441.54 feet and S. 89°57'14" E. a distance of 142.96 feet from the Southwest corner of the Northwest Quarter of Section 11, same being the Southeast corner of the Northeast Quarter of Section 10, Block E-2, Lubbock County, Texas; THENCE N. 89°57'14" W., at 142.96 feet pass the West line of Section 11 and the East line of Section 10, continuing for a total distance of 440.00 feet to a found 1/2" iron rod; THENCE N. 26°57'14" W. a distance of 385.00 feet to a 5/8" iron rod found at a point of curvature; THENCE Northeasterly around a curve to the right, said curve having a radius of 215.00 feet, a central angle of 135°, tangent lengths of 519.05 feet, and a chord distance of 397 .27 feet to a found 3/8" iron rod; THENCE S. 71°57'14" E., a distance of 224.83 feet to a point in the East line of Section 10 and the West line of Section 11 to a found 3/8" iron rod; THENCE S. 78°15'41" E., a distance of 145.99 feet to a found 1/2" iron rod; THENCE S. 00°02'46" W. a distance of 546.05 feet to the Point of Beginning. CONTAINS: 346,302.00 total square feet 332,970.60 net square feet SUBJECT TO THE fOLLOWING CONDITION: a. A site plan, including building elevations showing materials, color and texture, shall be submitted and approved by the Planning and Zoning Commission on the entire tract under this ordinance prior to the issuance of a building permit. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed the limits provided in Section 29-31(a) of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 2 - .. SECTION 4. THAT the City Secretary ia hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
