HomeMy WebLinkAboutOrdinance - 8884-1986 - Ordinance 8884 Amending 7084 To Change: Zone Case No. 1893-K - 01/23/1986'·· LJM:da First Reading January 23, 1986 Agenda Item #18 Second Reading February 13, 1986 Agenda Item #9 ORDINANCE NO. 8884 ----- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OffiCIAL MAP Of THE CITY Of LUBBOCK SO AS TO MAKE THE fOLLOWING CHANGES: ZONE CASE NO. 1893-K; A CHANGE Of ZONING fROMA-1 TO C-3 AND "GO" UNDER PROVISIONS Of SECTION 29-29 Of THE CODE Of ORDINANCES Of THE CITY Of LUBBOCK, ON A TRACT Of LAND OUT Of SECTION 2, BLOCK J-S, CITY Of LUBBOCK, LUBBOCK COUNTY, TEXAS; PROVIDING fOR A PENALTY AS PROVIDED fOR IN SECTION 29-31(a) Of THE ZONING ORDINANCE; PROVIDING A SAVINGS CLAUSE AND PROVIDING fOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordin- ances, City of Lubbock, Texas, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREfORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY Of LUBBOCK: ZONE CASE NO. 1893-K SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from A-1 to C-3 and "GO" under prov1s10ns of Section 29-29 of the Code of Ordinances of the City of Lubbock, on a tract of land out of Section 2, Block J-S, City of Lubbock, Lubbock County, Texas located at 6000 4th Street being further described as follows: C-3 METES AND BOUNDS DESCRIPTION of a 1 .487 acre tract located in Section 2, Block J-S, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears S. 89°58'21" W. an approximate distance of 1210.20 feet from the Southeast corner of Section 2, Block J-S, Lubbock County, Texas; THENCE S. 89°58'21" W. an approximate distance of 147.45 feet; THENCE North an approximate distance of 567.15 feet; THENCE S. 30° E. an approximate distance of 294.90 feet; THENCE South an approximate distance of 311.69 feet to the Point of Beginning. GO METES AND BOUNDS DESCRIPTION for a 8.129 acre tract of land located in Section 2, Block J-S, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bearsS. 89°58'21tt W. approximately 1417.65 feet and North 55.00 feet from the Southeast corner of Section 2, Block J-S, Lubbock County, Texas; THENCE S. 89°58'21" W. an approximate distance of 681.08 feet; THENCE North an approximate distance of 582.48 feet; THENCE Southeasterly around a curve to the right said curve having a radius of 673.27 feet, and an approximate chord distance of 59.77 feet to a point of reverse curvature; THENCE Southeasterly around a curve to the left, said curve having a radius of 674.17 feet, and an approximate chord distance of 268.82 feet; THENCE East an approximate distance of 347.00 feet to a point of curvature; THENCE Northeasterly around a curve to the left, said curve having a radius of 623.81 feet, and an approximate distance of 14.66 feet; THENCE South an approximate distance of 507.85 feet to the Point of Beginning. - 2 - SECTION 2. THAT violation of any prov1s1ons of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed the limits provided in Section 29-31(a) of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
