HomeMy WebLinkAboutOrdinance - 7901-1979 - Ordinance 7901 Amending 7984 To Change Zone Case No. 2244 Exterior Architectual - 08/23/1979ORDINANCE Nu. 7901 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2244; CHANGE ;LOTS 15, 16 AND 17, BLOCK 41, OVERTON ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM C-2 TO C-2 (DH) ZONING DISTRICT; DESIGNATING A LANDMARK THEREON; IDENTIFYING CERTAIN EXTERIOR ARCHITECTURAL FEATURES OF THAT LANDMARK; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, since 1944 the Lubbock Women's Club is a women's organization promoting, maintaining and supporting charitable, social, literary and edu- cational undertakings, and WHEREAS, their building located at 2020 Broadway is the first building in Lubbock to have the activities and functions of a women's club, and WHEREAS, their building was constructed in 1941 by Joseph James McLoen for Bryan McDonald and was originally used as the Plains Funeral Home until its sale in 1949 to the Lubbock Women's Club, and WHEREAS, the design of this women's club embodies many excellent exterior architectural features distinguishing the Georgian Revival architectural style, a stately manor home style which will probably never be built in Lubbock again in such an impressive scale a~ incorporated into this building, and WHEREAS, the Urban Design and Historic Preservation Commission for the City of Lubbock is of the opinion th~t the Lubbock Women's Club building should be perserved as part of our heritage for future generations and that the Lubbock Women's Club should be recognized for its fine work in preserving that building by making it a historic landmark of the City of Lubbock, and WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ,J ., ZONE CASE NO. 2244 SECTION 1. THAT Lots 15, 16 and 17, Block 41, Overton Addition, City of Lubbock, Lubbock County, Texas, BE and is hereby changed from C-2 to C-2 (DH) zoning district, and declared to be a historic landmark district. SECTION 2. THAT the main building located on the property described in Section 1 herein BE, and is hereby declared to be a historic landmark. SECTION 3. THAT any new buildings or structures within this historic landmark district shall be architecturally compatible with the historic land- mark structure therein, in terms of style, color, materials, texture and basic form as found in one of the following styles Georgian Revival, Neo-Classical Revival, Romanesque Revival, Federal Revival, Second Renaissance Revival, as described in the booklet, "Architecture in Lubbock: A Guide for Identification and Preservation," First Edition, 1979. SECTION 4. THAT the following BE and are hereby declared to be exterior architectural features, and as such shall be preserved in their present form: a. the exterior walls and roof, b. the four doric columns on the front facade, c. the side lights on the front entry, d. the keystone and brickwork over the windows, and doors on the first floor, e. the entablature showing the <lentils, f. the double-hung windows having 12 panes, g. the pilasters on the front facade, h. the raised panel exterior wooden doors, i. all painted surfaces shall be kept painted as needed for protection and appearance, with a color of paint similar to that used at present or contemporary and appropriate to its architectural period. SECTION 5. THAT the floor plans identified as. the floor plans for the LUBBOCK WOMEN'S CLUB, 2020 Broadway, shall be incorporated into this ordinance by reference, and by attaching hereto, and as such shall serve to indicate the arrangement of the exterior walls and windows of the building. SECTION 6. THAT incorporated by reference into this ordinance, and by attaching hereto, are photographs of the building as it presently.appears. ' Said photographs shall be used to indicate the degree of alteration which has already occured and the degree of preservation of the original structure. SECTION 7. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 8. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 9. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
