HomeMy WebLinkAboutOrdinance - 7892-1979 - Ordinance 7892 Amending Zoning Ordinance 7084 To Change Zone Case No. 2237 - 07/26/1979I•' ' ' LGB:hw ORDINANCE NO. 7892 ------ AN ORDINCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2237; CHANGE ALL OF BLOCK 232, ORIGINAL TOWN, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM M-1 TO M-l(J;tD) ZONING DISTRICT; DESIGNATING A LANDMARK THEREON; IDENTIFYING CERTAIN EXTERIOR ARCHITECTURAL FEATURES OF THAT LANDMARK; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the Fort Worth and Denver South Plains Railway Station, located at 1801 Avenue G, was built from the mid-to-late 1920's and served for many years as the principal portal to and from the City of Lubbock and has seen the presence of all manner of dignitaries and others who shaped the growth of this city, and WHEREAS, there is a nationwide sentiment growing for the preservation of the memory of railroading as part of our national heritage, and this railway station is a reminder of the part the railroad played in the early development of this city, and WHEREAS, this railway station was designed by Wyatt C. Hedrick, an archi- tect well known in Lubbock for his buildings on the Texas Technological College campus where he used a design evolved from the architecture of the University of Salamanca in Spain--a design which he also incorporated into this railway station, and WHEREAS, the design of this railway station embodies many excellent exterior architectural features distinguishing the Spanish Renaissance Revival archi- tectural style, reflects a high quality of design, detail, materials and crafts- manship, and demonstrates the far reaching influence of Spanish culture in the arthitecture of modern times, and WHEREAS, this railway station had become obsolete and fallen into disrepair until Ronald E. Thompson recognized its historical and cultural importance and through careful renovation and restoration retained its unique qualities while making an adaptive reuse of the railway station as "The Depot" restaurant and bar, and WHEREAS, the Urban Design and Historic Preservation Connnission for the City of Lubbock is of the opinion that the railway station should be preserved as part of our heritage for the future and that Ronald E. Thompson should be recognized for his part in preserving that station by making it the first historic landmark to be designated in the City of Lubbock, and WHEREAS, the proposed change in zoning as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that it would be in the best interest of the public welfare to make the proposed change in zoning, and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the / , , proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2237 SECTION 1. THAT all of Block 232, Original Town, City of Lubbock, Lubbock County, Texas, BE and is hereby changed from M-1 to M-l(ftD) zoning district, and declared to be a historic landmark district. SECTION 2. THAT the building located on the west half of said Block 232, BE and is hereby declared to be a historic landmark. SECTION 3. THAT any new buildings or structures within this historic landmark district shall be architecturally compatible with the historic land- mark structure therein, in terms of style, color, materials, texture and basic form as found in one of the following styles: Mission, Spanish Colonial Re- vival, Pueblo, or Spanish Renaissance Revival, as described in the booklet, "Architecture in Lubbock: A Guide For Identification and Preservation", First Edition, 1979. SECTION 4. THAT the following BE and are hereby declared to be ex- terior architectural features, and as such shall be preserved in their present form: a. the exterior walls and roof, b. the red clay roofing tiles on the roof, c. the brick chimney with stone cap and terracotta chimney pots, d. the stone coping on the north and south parts of the roof, e. the brick and carved stone facade, f. the exposed stone foundation, g. the location of the doors and windows, including the bay window on the east. h. the window grilles, i. the wooden doors, except for the main entrance which may be of other materials, j. all brick, stone and tile shall remain unpainted; the grilles, doors and windows, shall be kept painted as needed for protection and appearance, with a color of paint similar to that used at present or contemporary and appropriate to its original use. SECTION 5. THAT Section 3 shall apply only to that part of the building which comprised the original structure, and not to the modern additions. SECTION 6. THAT pages 1, 3 and 4 of the original building plans, identified as the F.W. & D.S.P. RY. Co., LUBBOCK, TEXAS, BRICK PASS. & FRT. DEPOT and dated June 6, 1928, shall be incorporated into this ordinance by reference, and by attaching hereto, and as such shall serve to indicate the original design and detailing of the exterior architectural features of the building. 11 ii I ' SECTION 7. THAT incorporated by reference into this ordinance, and by attaching hereto, are photographs of the building as it presently appears. Said photographs shall be used to indicate the degree of alteration which has already occured and the degree of preservation of the original structure. These photographs shall be further identified as follows: No, 1: general view, west side, north end. No. 2: general view, west side, south end. No. 3: general view, south and east sides, looking northwest. No. 4: general view, north side, east end. No. 5: general view, north side, west end. No. 6: view of loading dock, east side of building. No. 7: general view, east side, south end. Ne. 8: general view, east side, middle. No. 9: general view, east side, north end. No. 10: close view of entry door, showing brick and stone facade. No. 11: close view of chimney, roof and window, showing brick and stone facade. SECTION 8.. 'THAT violation of any provisions of this ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 9. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 10. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
