AN ORDINANCE AMENDING ORDINANCE NO. 6111 OF THE CITY OF LUBBOCK BY DELETING
ONE FLASHING SCHOOL ZONE THEREIN AND AUTHORIZING THE ALTERING AND CHANGING OF
THE PRIMA FACIE SPEED LIMIT THEREAT TO 35 MPH AS PROVIDED HEREIN; AUTHORIZING
THE PLACING OF SPEED LIMIT SIGNS: REPEALING ALL ORDINANCES OR PARTS THEREOF IN
CONFLICT HEREWITH; PROVIDING THAT STREETS AND HIGHWAYS NOT SPECIFICALLY SET
FORTH HE~EIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT ORDINANCES
EXCEPT THOSE WITH WHICH IT SPECIFICALLY CONFLICTS; PROVIDING A SAVINGS CLAUSE;
PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE AND
PROVIDING FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock, upon the basis of an
engineering and traffic investigation, finds that it is necessary to alter the
prima facie speed limits established by Article 6701d, Sec. 166 (a)(l), Vernon's
Texas Civil Statutes, as amended by the Texas Legislature, within the areas and
locations named and described in the body of this Ordinance, and within the
corporate limits of the City of Lubbock.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the prima facie speed limit established by Art. 6701d,
Sec. 166 (a)(l), Vernon's Texas Civil Statutes, is altered and changed for all
vehicular traffic to thirty-five (35) miles per hour on the following described
streets and highways within the corporate limits of the City of Lubbock, Lubbock
County, Texas, to-wit:
A 35 MPH Zone for the Eastbound and Westbound traffic for
West 34th Street beginning at 231 feet West of the center
line of Chicago Avenue and extending East for 441 feet to
a point 210 feet East of the center line of Chicago Avenue.
SECTION 2. THAT the City Manager is authorized and directed to cause
the placing of signs and traffic control signals so as to clearly define the
limits of the prima facie areas set out in this Ordinance, and give notice when
such speed limit shall be in effect.
SECTION 3. THAT all Ordinances or parts of Ordinances conflicting with
any of the provisions hereof are hereby repealed insofar as such conflict
exists.
SECTION 4. THAT all highways or streets not specifically set forth in
the preceeding sections hereof shall not be affected by the provisions hereof,
and this Ordinance shall be cumulative of all other prima facie speed limit
Ordinances except those with which it specifically conflicts.
SECTION 5. THAT violation of any provisions of this Ordinance shall be
deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as
provided in Section 1-5 of the City Code.
SECTION 6. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 7. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
