AN ORDINANCE AMENDING CHAPTER 5 OF THE CODE OF ORDINANCES FOR THE CITY OF LUBBOCK, BEING THE BUILDING CODE, BY AMENDING SECTIONS 1304 AND 1404 OF THE UNIFORM BUILDING CODE, 1976 EDITION, AS ADOPtED BY THE CITY OF LUBBOCK, PER- TAINING TO THE MINIMUM SIZE OF CERTAIN WINDOWS IN SLEEPING AREAS, PROVIDING FOR AN EFFECTIVE PERIOD, PROVIDING FOR A PENALTY AS PROVIDED IN SECTION 1-5 OF THE CITY CODE, PROVIDING FOR A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION AND DECLARING AN EMERGENCY. WHEREAS, the City Council, after receiving the recommendation of the Building Board of Appeals, has found that the changes indicated below would be in the best interest of the citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LU:BBOCK: SECTION 1. THAT the last paragraph of Sections 1304 and 1404 of the Uniform Building Code, 1976 Edition, as adopted by the City of Lubbock, BE and is hereby amended to read as follows: "All egress or rescue windows from sleeping rooms shall have a min- imum net clear opening of 24 inches by 16 inches either by height or width and shall provide a minimum net clear opening of 3.33 square feet. All egress or rescue windows installed in sleeping rooms between 12:01 a.m. November 20, 1977, and midnight December 31, 1979, which meet the aforementioned dimensions shall be deemed to be in full compliance with this code. All egress or rescue windows from sleeping rooms installed after mid- night, December 31, 1979, shall also have a minimum net clear opening width dimension of 20 inches and a minimum net clear opening of 5.7 square feet." SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. SECTION 5. THAT the fact that public necessity and convenience re- quires that. this Ordinance be passed as an emergency measure for the reasons set forth in the preamble hereof, the rule requiring that no ordinance shall be finally passed on the day of its introduction be suspended and this Ordinance is declared to be an emergency measure to take effect from and after its passage and publication as set forth hereinabove. AND IT IS SO ORDERED.
