AN ORDINANCE DESIGNATING A REINVESTMENT ZONE WITHIN Tl IE
CITY OF LUBBOCK AS AUTHORIZED BY CHAPTER 312, TAX CODE;
DESCRIBING THE BOUNDARIES OF SAID ZONE: DESCRIBING THE
ELIGIBILITY OF SAID ZONE FOR COMMERCIAL-INDUSTRIAL TAX
ABATEMENT: PROVIDING A SAVING CLAUSE AND PROVIDTNG FOR
PUBLICATION.
WHEREAS. Chapter 312 of the Tax Code authorizes the City Council or the City
of Lubbock to designate a Reinvestment Zone for Commcrcial-lmlustrial tax abatement
purposes: and
WHEREAS, the City or Lubbock has heretofore established its intent to
participate in tax abatement by Resolution and has established guidelines and criteria for
commercial-industrial tax abatement within the City of Luhbock; and
WHEREAS, the City Council of the City of Lubbock did declare its intent to
create said Reinvestment Zone by its adoption of Resolution No. 20 I 2-R0453 on
November 29, 2012: and
WHEREAS. City Council did cause a Notice of Intent to create said
Reinvestment Zone to be delivered to all taxing units levying taxes on real property
within the zone; and
WHEREAS, the boundaries of the Reinvestment Zone were described m the
Exhibit A attached to and made a part of Resolution No. 20 I 2-R0453; and
WHEREAS, the City Council did hold a public hearing to consider the
establi!:ihm ent of said reinvestment zone as hereinafter described, which said hearing was
conducted on December 17, 20 I 2. prior to the adoption of this Ordinance; and
WI IEREAS. the City Council did find at the conclusion or said hearing that the
improvements sought for the property ,vithin the Reinvestment Zone arc feasible,
practical and would benefit the land; and
WHEREAS. the City Council of the City of Lubbock has determined and finds
that the real property to be included in the Reinvestment Zone w·ill be reasonably likely
as a result of the designation to contribute to the retention or expansion of primary
employment and would contribute-to the economic development of the City of Lubbock:
NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1: TI IAT by and under the authority of Chapter 312. Tax Coe.le, the
followi ng described real property located within the City of Lubbock. County of
Lubbock, Texas. is hereby designated as a Reinvestment Zone:
METES AND BOUNDS DESCRIPTION OF a 11 .809 acn: tract out of a 64.5
acre tract as described in Volume 1234. Page 650 of the Deed Records of Lubbock
County. Texas. located in Section 3, Block 0, Lubbock County. Texas, being further
described as follows:
BEGINNING at a 3/4" iron pipe found in the South right-of-way line of East 14th Street.
at the most Westerly Northwest corner of sai<l 64.5 acre tract and this tract. same being
tht! original Northeast corner or Lot 3, Hill /\c.ldition to the City or Lubbock, Lubbock
County, Texas. according to the map, plat and/or dedication deed thereof recorded in
Volume 1349. Page 533 or the Deed Records or Lubbock County. Texas. from whence a
found 3/4" iron pipe bears N. 88°12' W. 250.00 feet:

said 64.5 acre tract. a distance of 130.70 feel to a 1/2'' iron rod with cap set for a corner of
said 64.5 acre tract and this tract

boundary of said 64.5 acre tract. a distance of 15.00 feet to an --x,-cut in com:rele in the
South right-of-way line of East 14th Street as described in Volume 3 78, Page 303 of the
Dccc.l Records of Lubbock County, Texas, for the most Northerly Northwest <.:orner of

THENCE S. 88°12' E .. continuing along said South right-of-way line and the Northern
boundary of said 64.5 acre trnct, a distance of 961.84 feel to a 1/2" iron rod with cap set
for the Northeast corner of this tract, from whence a fou nd 3/4" iron pipe bears S. 88°12'
E. 429.29 feet;
THENCE S. 01 °48' W. a distan<.:c of 301.00 foct to a 1/2" iron rod with cap set for the
Southeast corner or this tract;

feet to a 3/4" iron pipe found at the Southeast corner of said Lot 3, Hill Addition, a corner
of said 64.5 acre tract and the most Westerly Southwest corner of this tract;

Western boundary of said 64.5 acre tract, a distance of 460.90 feet to the Point of
Beginning.

SECTION 2. THAT the area of the Reinvestment Zone will be reasonably likely
as a result of the designation to contribute to the n:tention or expansion of primary
employment and will contribute to the economic development of the City of Lubbock.
SECTION 3. TIIA T should any paragraph, section. sentence. phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
