.. AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF
THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2103-A;
CHANGE A TRACT OF LAND OUT OF SECTION 4, BLOCK E, CITY OF LUBBOCK, LUBBOCK
COUNTY, TEXAS, FROM A-1 TO R-2 ZONING DISTRICT; CHANGE A TRACT OF LAND OUT OF
SECTION 4, BLOCK E, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM A-1 TO C-2
ZONING DISTRICT; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE
CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning districts as hereinafter made have
been duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the City
Council finds that making the proposed changes as hereinafter set out will be
in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 26 of Ordinance-No. 7084, as well as notices
provided by Article lOllf, Vernon1 s Annotated Civil Statutes, amended in 1961,
and notice was duly published in the Lubbock Morning Avalanche-Journal more
than fifteen (15) days prior to the date of the public hearing before the City
Council on such proposed amendment, and the public hearing according to said
notice was duly held in the City Council Room on the second floor of the City
Hall, Lubbock, Texas, at which time persons appeared in support of the proposal;
and, after said hearing, it was by the City Council determined that it would be
in the public interest, due to changed conditions, that the Zoning Ordinance
and the Zoning Map be amended in the manner hereinafter set forth in the body
of this Ordinance and this Ordinance having been introduced prior to first
reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the
same are hereby amended as follows, to-wit:
ZONE CASE NO. 2103-A
A. Change a tract of land out of Section 4, Block E, Lubbock County,
Texas, from A-1 to R-2 zoning district. This property is further
described by metes and bounds as follows:
BEGINNING at a point in the North line of 74th Street, said point
bearing North 89°57'03" East a distance of 979.98 feet and North
00°02 157" West a distance of 30 feet from the Southwest corner
of the Northwest Quarter of Section 4, Block E;
THENCE Northerly around a curve to the left, said curve having a
radius of 15 feet, a delta angle of 90°, tangent lengths of 15 feet,
and a chord distance of 21.21 feet;
THENCE North 00°02'57" West a distance of 260.55 feet to a point
of curvatur e;
THENCE Westerly around a curve to the left, said curve having a
radius of 15 feet, a delta angle of 90°, tangent lengths of 15 feet,
and a chord distance of 21.21 feet;
THENCE South 89°57'03" West a distance of 130 feet;
THENCE South 00°021 57" East a distance of 290.55 fee t;
THENCE North 89°57'03" East a distance of 130 feet to the
POINT OF BEGINNING.
B, Change a tract of land out of Section 4, Block E, Lubbock County,
Texas, from A-1 to C-2 zoning district. This property is further
described by metes and bounds as follows:
BEGINNING at a point in the North line of 74th Street, said point
bearing North 89°57'03" East a distance of 849.98 feet and North
00°02'57" West a distance of 30 feet from the Southwest corner
of the Northwest Quarter of Section 4, Block E;
THENCE North 00°02'57" West, a distance of 290.55 feet;
THENCE South 89°57'0311 West, a distance of 464.38 feet to a
point of curvature;
THENCE Southerly around a curve to the left, said curve having
a radius of 50 feet, a delta angle of 90°, tangent lengths of 50
feet, and a chord distance of 70,71 feet;
THENCE South 00°02'5711 East, a distance of 225.55 feet to a point
of curvature;
THENCE Easterly around a curve to the left, said curve having a
radius of 15 feet, a delta angle of 90°, tangent lengths of 15 feet,
and a chord distance of 21,21 feet;
THENCE North 89°57'03" East, a distance of 499.38 feet to the
POINT OF BEGINNING,
SECTION 2. THAT from and after passage and effective date of this
Ordinance said lots. tracts and parcels of land described in Section 1 hereof
shall be changed to the zoning district indicated and the Official Map is
amended in accordance herewith,
SECTION 3, THAT violation of any provisions of this ordinance shall be
deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as
provided in Section 1-5 of the City Code.
SECTION 4. THAT should any section, paragraph, sentence, clause. phrase
or word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause publication
of the descriptive caption of this Ordinance as an alternative method provided
by law.
