LGB: l}w -7792 ORDINANCE NO. ______ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 2200-A; CHANGE A TRACT OF LAND OUT OF SECTION 9, BLOCK A, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM R-1 TO C-2 ZONING DISTRICT; PROVIDING FOR A PENALTY AS PRO- VIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PRO- VIDING FOR PUBLICATION, WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011£, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche- Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner here- inafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 2200-A Change a tract of land out of Section 9, Block A, City of Lubbock, Lubbock County, Texas, from R-1 to C-2 zoning district. This property is further described by metes and bounds as follows: BEGINNING at a (found)½" iron pipe which bears South 2171.44 feet and East 2431.94 feet from the Northwest corner of Section 9, Block A; THENCE North 89°591 33" East a distance of 120,10 feet to a (found)½:" iron pipe; THENCE North 00°01125" West a distance of 387.60 feet to a (set)½" square metal tube; THENCE South 89°58'35" West a distance of 32 feet to a (set)½" square metal tube; THENCE North 00°011 25" West a distance of 30 feet to a (set)½" square metal tube; THENCE North 89°581 35" East a distance of 32 feet to a (set) !:i:" square metal tube; THENCE North 00°01'25" West a distance of 104.2 feet to a (found)½" iron pipe; THENCE North 89°591 26" East a distance of 361.94 feet to a (found) ½" iron pipe; THENCE South 34°15'57" East a distance of t47.57 feet to a (found) 7/8" rod; THENCE South 20°31 15211 East a distance of 50 feet to a (found) 7/8" rod; THENCE North 82°37 15211 East a distance of 46.11 feet to a (set)½" square metal tube; THENCE N 31°201 24" East a distance of 175,77 feet to a (set)½" square metal tube; THENCE S 46°08 1 36" East a distance of 40.95 feet to a (set)½" square metal tube; THENCE S 31 °20 '24" West a distance of 221. 16 feet to a (found) ½" iron pipe; THENCE S 81°10'57" East a distance of 99,9 feet to a (set)½" square metal tube; THENCE,s 08°44 150" West a distance of 292.93 feet to a (found) railroad spike; THENCE N 81°13 1 08" West a distance of 42.65 feet to a (found) railroad spike; THENCE N 36°34'5311 West a distance of 8.64 feet to a (found) railroad spike; THENCE s 52°031 52" West a distance of 50. 11 feet to a (found) 3/8" rod; THENCE s 00°00'49" West a distance of 462 feet to a (set)½" square metal tube; THENCE N 89°59'52" West a distance of 499.78 feet .to a fence corner post; THENCE N 00°02'37" West a distance of 278.64 feet to a (found) 3/8" rod; THENCE N 89°56'26" West a distance of 73.91. feet to a (found) 3/8" rod; THENCE N 07° 18 I 14" West a distance of 215.22 feet to the POINT OF BEGINNING. SECTION 2. THAT from and after passage and effective date of this Ordinance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. SECTION 3. THAT violation of any provisions of this ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City C0de. SECTION 4. THAT should any ,section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
