AN ORDINANCE AMENDING CHAPTER 15 OF THE CODE OF ORDINANCES OF THE CITY OF
LUBBOCK, TEXAS, BY AMENDING SECTION 15-50 REGULATION 3 (a) REGARDING SWIMMING
POOL PERMITS AND FEES; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION
AND DECLARING AN EMERGENCY.
WHEREAS, the City Council has determined that altering the fees to be
charged by the City Health Department for the issuance of permits and for in-
spections would be in the best interest of the health, safety and general welfare
of the citizens of the City of Lubbock; and
WHEREAS, the 'City Council finds that the fees presently charged are insuf-
ficient to cover expenses incurred by the City Health Department in conducting
such functions and that such functions are an absolute necessity in protecting
the health of the citizens of the City of Lubbock, there is created an emergency
which requires the immediate passage of this measure; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Chapter 15 of the Code of Ordinances of the City of Lubbock
BE and is hereby amended by amending Sec. 15-50, Regulation 3(a) of said
Chapter to read as follows:
(a) Pennits. No public or semi-public swimming pool shall
be maintained or operated in the city without a permit in force
issued by the City Health Department, or otherwise in accordance
with the terms of the permit and these regulations. The permit
shall be displayed in a conspicuous place on the premises where
it may be readily observed by all patrons. All such permits
expire December 31 of each year. The fee for such permit shall
be twenty-five dollars ($25.00) per year.
SECTION 2. THAT should any section, paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.
SECTION 3. THAT the City Secretary is hereby authorized to cause publication
of the descriptive caption of this Ordinance as an alternative method provided
by law.
SECTION 4. THAT the fact that public necessity and convenience requires that
this Ordinance be passed as an emergency measure for reasons set forth in the I
preamble hereof, the rule requiring that no Ordinance shall be finally passed
on the day of its introduction be suspended, and this Ordinance is declared to be
an emergency measure to take effect from and after its passage and publication
as set forth hereinabove.
