HomeMy WebLinkAboutOrdinance - 6333-1972 - Amending Zoning Ord #1695 And Lubbock Map For Chagnes: Zone Case #7099 - 03/22/1972KJ:11 G3 ORDINANCE NO. 6333 AN ORDINANCE A:MENDING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1799: CHANGE LOTS 17 AND THE WEST 5 FEET OF LOT 18., BLOCK 28., OVERTON ADDITION, CITY OF LUBBOCK., LUBBOCK COUNTY., TEXAS., FROM AN "R-211 TO AN r,fA-2V ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVIDING FOR A PEN- ALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICA- TION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendation., which was received by the City Council and. after due con- sideration, the City Council finds that making the proposed change as herein- after set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 1011f, Vernon's Annotated Civil Statue,p, amended in 1961, and notice was duly published in the Lubbock Morning Ava- lanche Journal more than fifteen (15) days prior to the date of the public hear ing before the City Council on such proposed amendment, and the public hear ing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appear ed in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions,, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: .,) u SUBJECT TO THE FOLLOWING CONDITIONS: 1. MINIMUM LANDSCAPING Fifteen {15) percent of the total lot area shall be landscaped and permanently maintained. A portion of said landscaping shall be visible from the fronting street. Landscaping shall be defined as changing the features of the required area by adding lawns., trees, bushes, etc. so as to produce the most attractive and/or desirable effect. Plans for landscaped areas shall be submitted to be checked and appr.oved by the Director of Planning. SECTION 2. THAT from and after passage and effective date of this Ordinance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the Zoning District indicated and the Official Map is amended in accordance herewith. SECTION 3. THAT any person, firm or corporation owning or oper- ating the subject property failing to comply with the conditions imposed by Section 1 hereof shall be guilty of a misdemeanor and upon conviction there- of, shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day's violation thereof shall constitute a separate and distinc offense. The failure of any corporation owning or operating the subject prop- erty to comply with any of the conditions imposed by Section 1 hereof shall render the President, Vice-President, General Manager, Local Manager an Local Agent liable to the penalty prescribed in this section. SECTION 4. THAT should any paragraph, sentence, clause., phrase or word of this Ordinance be declared unconstitutional or invalid for any rP.ason. thP. remainder of this Ordinance shall not be affected thereby.
