HomeMy WebLinkAboutOrdinance - 2018-O0146 - Amending Chapter 40 Code Of Ordinances. - 12/17/2018First Reading December 17, 2018 Item No. 7.1 ORDINANCE NO. 2018-00146 Second Reading January 10, 2019 Item No. 7.12 AN ORDINANCE AMENDING CHAPTER 40, "ZONING", OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS BY ADDING SECTION 40.04.016 ALLOWING FOR AND REGULATION OF FREEST ANDING RESIDENTIAL SUBDIVISION SIGNS; PROVIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the Planning & Zoning Commission of the City of Lubbock, Texas (the "Commission"), during its meeting on November 6, 2018 heard the proposed changes in zoning as hereinafter made and were duly presented to the Planning and Zoning Commission for its recommendation, with the Commission recommending approval of the proposed changes in zones; and WHEREAS, the Commission recommends approval of a zoning amendment to allow for freestanding residential subdivision signs in compliance with regulations set forth within the same section; and WHEREAS, the City Council voted to approve the proposed changes m Zoning; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Code of Ordinances, City of Lubbock, Texas, is hereby amended by adding a section, to be numbered 40.04.016, which said section reads as follows: Sec. 40.04.016 Freestanding Residential Subdivision Signs Freestanding signs for single-family and two-family residential developments containing more than ten units shall be permitted on any zoning district subject to the following regulations: ( 1) Sign shall be limited to the residential subdivision name and located within a 500 foot radius of the residential subdivision property. (2) A residential subdivision sign will not be counted towards any other zoning district maximum. (3) One ( 1) gateway sign per street frontage per residential subdivision shall be allowed. (4) One (1) gateway sign may consist of multiple structures, subject to staff review and approval. (5) Area: Each sign shall have a maximum sign copy area of 25 square feet. (6) Each sign shall have a total height restriction of 8 feet. (7) Illumination of any kind shall be in compliance with Article 40.04. (8) No electronic message displays shall be allowed. (9) The sign shall be placed so as not to obstruct visibility from any driveway curb cut, alley return, or driveway-alley combination. ( l 0) Freestanding signs shall be of a pedestal or monument type. ( 11) Construction materials shall be compatible with other structural forms and materials located within, and representative of, the subdivision. Elevation drawings shall be submitted for staff review prior to issuance of a building permit, showing construction materials and detail. SECTION 2. THAT, violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and Noll 00 Dollars ($2,000.00) as provided in Section 40.01.006 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. SECTION 5. THAT this Ordinance shall become effective, except as may otherwise be provided herein, from and after its publication as provided by law. AND IT IS SO ORDERED.
