HomeMy WebLinkAboutOrdinance - 7775-1978 - Ordinance Amending Zoning Ordinance 7084 To Change Zone Case No. 2210 - 12/07/1978G II LGB:hw '!~::Y ORDINANCE NO, 7775 --~ ,:: .. ==========================================~== , f::, v ' I AN ORDINANCE AMENDINq ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO, 2210; CHANGE A TRACT OF LAND 'OUT OF SECTION 28, BLOCK E-2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO A-1 ZONING DISTRICT; CHANGE A TRACT OF LAND OUT OF SECTION 28, BLOCK E-2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO R-2 ZONING DISTRICT; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No, 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche- Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner he reinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No, 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO, 2210 Change a tract of land out of Section 28, Block E-2, Lubbock County, Texas, from R-1 to A-1 zoning district, This property is further described by metes and bounds as follows: BEGINNING at a 5/8" iron rod found in the centerline of 66th Street for the Southwest corner of this tract, said point bears N 89° 551 W, 2310.0 feet from the Southeast corner of Section 28, Block E-2, Lubbock County, Texas; THENCE N 89° 54'45" W, along the centerline of 66th Street, a distance of 662.82 feet to a 111 square tube set for the Southwest corner of this tract; = Jj LGB:hw THENCE North at 32 "feet pa~s a 1" square iron tube set, continuing for a total distance of 1315.67 feet to a 1" square iron tube set in the South R-0-W line of Loop 289 as the Northwest corner of this tract; THENCE Southeasterly around a curve to the right, said curve having a radius of 2758.79 feet, a delta angle of 5° 32 1 47", and a chord distance of 266.96 feet to a 1" square iron tube set; THENCE S 60° 50'30" E, a distance of 481.12 feet to a 1/2" square iron tube found for the North- east corner of this tract; THENCE S 0° 12'34" E, a distance of 963.61 feet to the PLACE OF BEGINNING. SECTION 2. THAT from and after passage and effective date of this Ord- inance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. SECTION 3. THAT violation of any provisions of this ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 4. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. ;-\' . f...
