ORDINANCE NO. 7750 AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES, CITY OF LUBBOCK, TEXAS, BY AMENDING SECTION 2-38 THEREOF TO PROVIDE FOR THE DISTRIBUTION OF ELECTRIC REVENUE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council has determined that the changes indicated below relating to the distribution of electric revenues wou1d be in the best interest of the citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 2 of the Code of Ordinances, City of Lubbock, BE and is hereby amended by amending the first paragraph of Section 2-38 thereof to read as follows: Sec. 2-38. Distribution of Electric Revenues. All monies received from the operation of Lubbock Power and Light shall be deposited in the Electric Light and Power Fund. From these funds shall be paid: (1) All necessary operations, maintenance and betterment charges and expenses of the system, (2) Amounts sufficient to establish and maintain the bond ftmd including the reserve portion thereof, (3) all other lawful obligations and indebtedness of the System chargeable against the System, as and when they accrue and become due. In addition to the above expenditures paid from gross revenues, Lubbock Power and Light shall transfer into General Fund of the City of Lubbock four percent (4%) of that portion of gross sales to general consumers and to the City of Lubbock derived from the fuel cost adjustment, and shall transfer to the General Fund eight percent (8%) of all other gross sales of electricity to general consumers and to the City of Lubbock. The term "Gross Sales11 shall mean the gross electrical operating sales from energy and from fuel cost adjustments after deducting for refunds and allowances as applicable thereto. Of the percentage transfers described, two percent (2%) applied to gross sales shall be as a payment equivalent to the franchise tax paid by other utilities, and all other portions of the transfer shall be as a payment to reimburse the general government for costs incurred in behalf of Lubbock Power and Light and as a dividend. One percent (1%) of the gross sales from the fuel cost adjust- ment shall be retained by Lubbock Power and Light for capital improvement projects. ~ECTION 2. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. •, ,..
