ORDINANCE NO. ·.....zz.4~ AN ORDINANCE .AMENDING CHAPTER 11 OF THE CODE OF ORDINANCES, CITY OF LUBBOCK, TEXAS, ENTITLED "ELECTRICITY," BY AMENDING SECTION 11-1 THEREOF TO PROVIDE FOR FUEL COST ADJUSTMENTS: PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council has determined that the changes indicated below relating to the consideration of requests for fuel cost adjustments in electric rates would be in the best interest of the citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 11 of the Code of Ordinances, City of Lubbock, BE and is hereby amended by amending the first paragraph of Section 11-1 thereof to read as follows: Sec. 11-1. Rates for service furnished in city. The following rates shall be charged for electric service fur- nished in the city according to classifications herein set out, by all persons, firms or corporations engaged in furnishing such electric power service to the public, including electric service furnished by the city's electric light system; provided however, the net charge per kilowatt hour, as specifically set out here- inafter, shall be increased or decreased 0.0067 cent per kwh for each 0.5 cent increase or decrease, or major fractions thereof, in the cost of fuel delivered at LP&L generating stations, above or below 21 cents per 1,000,000 Btu. The cost of fuel shall be determined as follows: SECTION 2. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
