HomeMy WebLinkAboutOrdinance - 7746-1978 - Ordinance 7746 Amend 7984 By Amending Section 26.3-3 Pertaining Three-Fourths - 09/28/1978--JGB:hw ORDINANCE NO. 7746 AN ORDINANCE AMENDING ORDINANCE NO. 7084 OF THE CITY OF LUBBOCK, BEING THE ZONING CODE, BY AMENDING SECTION 26.3-3 OF SAID CODE PERTAINING TO A THREE-FOURTHS VOTE OF THE CITY COUNCIL ON ZONE CASES OBJECTED TO BY TWENTY PERCENT OF CERTAIN LANDOWNERS, PROVIDING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that after all notices have been given and hearings held as provided by law, that it is in the best interest of the citizens of the City of Lubbock to make the changes in the Zoning Code as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 26. 3-3 of the Zoning:· Code, Ordinance No. 7084 of the City of Lubbock, BE and is hereby amended to read as follows: "Section 26.3-3 In case the Planning and Zoning Connnission has recommended against a proposed amendment, supplement, change or modification, or, of protest against such change, signed by owners of twenty (20) percent or more either of the area of the lots or land included in such proposed change, or of the lots or land immediately joining proposed change and extending two hundred (200) feet therefrom, such amendment shall not become effective except by the favorable vote of three-fourths (3/4) of the City Council." SECTION 2. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. Violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
