Zone Case 2007-E - 09/14/2017First Reading September 14, 2017 Item No. 7.1 Second Reading September 28, 2017 Item No. 7.8 ORDINANCE NO. -2017 00118 AN ORDINANCE AMENDING ZONING ORDINANCE NUMBER 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2007-E; AMENDING THE CONDITIONS SET FORTH IN ORDINANCE NO. 7622 BY REMOVING A CONDITION LIMITING DEVELOPMENT ON THE TRACT TO THE SITE PLAN APPROVED BY THE CITY COUNCIL ON FEBRUARY 23, 1978 FOR TRACT A-1, AVALON ADDITION, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giving notices in compliance with Section 40.01.005 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (1 5) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2007-E SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended to reflect the removal of a condition from City of Lubbock Ordinance No. 7622, with the remaining conditions in Ordinance No. 7622 being listed follows: "SECTION 1. THAT the following conditions shall be placed on Tracts A, B, C, and the northwest four hundred fifty-two and ninety-eight one hundredths feet (452.98') of Tract E, Avalon Addition: I. Screening for service areas and garbage collections for three buildings along Slide Road shall be required. Zone Case 2007-f: (Amendment to 7622} Page I 2. No car wash, service station, or drive-in restaurant uses shall be permitted on this tract. 3. A minimum of five percent (5%) landscaping shall be required. 4. No fencing or barriers shall be placed between tracts so as to prohibit vehicular traffic between tracts. 5. The front, side, and rear setbacks shall be as required by Zoning Ordinance and shall be shown on site plan. 6. The alley on this tract (starting at York Drive) is to be paved, with a six foot (6') screening fence to be located thereon six inches ( 6") inside of the east side of alley. 7. Pedestrian gates shall be provided in the alley fence to permit adjoining landowners access to garbage containers in the alley. 8. Driveway access from 62nd Street shall be a minimum one hundred fifty feet (!50') from Slide Road. 9. No outside sales, banners, pennants, or other promotional activities shall be allowed. SECTION 2. THAT this amendment shall permit the requestor to develop Tract A-1, Avalon Addition, City of Lubbock, Lubbock County, Texas, located at 6253 Slide Road, without the condition that such development be in accordance with the site plan approved by the City Council on February 23, 1978. SECTION 3. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and No/1 00 Dollars ($2,000.00) as provided by Section 40.01.006 of the Zoning Ordinance of the City of Lubbock, Texas. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of the Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED. ZONE CASE NO. 2007-C; CHANGE TRACTS A, B, C, D AND THE NORTHwEST 452.98 FEET OF TRACT E, AVALON ADDITION, BY AMENDING THE CONDITIONS THERE- ON; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in Zoning Ordinance No. 7586 as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendatiot which was received by the City Council and, after due consideration, the City Counci finds that making the proposed changes as hereinafter set out will be in the public interest; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance NO. 7586 .Pf the City of Lubbock BE and is hereby amended by amending the conditions thereon·; .. ZONE CASE NO. 2007-C: The following conditions shall replace those conditions previously placed on Tracts A, B, C and the Northwest 452.98 feet of Tract E, Avalon Addition: 1. Development on this tract shall be in accordance with the site plan approved by the City Council on February 23, 1978. 2. Screening for service areas and garbage collections for three build- ings along Slide Road shall be required. 3. No car wash, service station, or drive-in restaurant uses shall be permitted on this tract. 4. A minimum of 5% landscaping shall be required. 5. THAT from and after passage and effective date of this Ordinance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance here- with. SECTION 3. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the re- mainder of this Ordinance shall not be affected thereby. io LGB:bsb SECTION 4.
