HomeMy WebLinkAboutOrdinance - 7709-1978 - Ordinance No. 7709 Altering Speed Limits On Portion Of Indiana Avenue - 08/10/1978., ORDINANCE NO. 7709 JWf :yl;l • ------ ' AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ON A PORTION OF INDIANA AVE}IDE IN THE CITY OF LUBBOCK AS HEREINAFTER MORE PARTICULARLY DESCRIBED IN THE BODY OF TRIS ORDINANCE: DIRECTING PLACEMENT OF SIGNS WITH RESPECT THERETO; REPEAL- ING CONFLICTING ORDINANCES TO THE EXTENT OF SUCH CONFLICT; APPLICATION OF THIS ORDINANCE ONLY TO STREETS OR HIGHWAYS NAMES HEREIN; PROVIDING THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SAVINGS CLAUSE AND FOR PUBLICATION HEREOF, AND A PENALTY CLAUSE. WHEREAS, the governing body of the City of Lubbock, upon the basis of an engineering and traffic investigation finds it necessary to alter pri.ma facie speed limits established by Article 6701d, Section 166(a) 1, Vernon's Te:xas Civil Statutes as amended Acts 1971, 62nd Legislature, Page 708, Chapter 73, within the area and 1at the location named and designated in the body of this Ordinance, all within the 1 corporate limits of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT prima facie speed limits on the following streets and high- ways in the urban district set forth below is hereby altered and changed as herein- after set forth upon the following described portions of streets and/or highways located within the City of Lubbock, Lubbock County, Texas, to-wit: INDIANA AVENUE -82ND TO 96TH STREET A 45 Miles Per Hour speed zone for both sides of Indiana Avenue beginning at 82nd Street and extending South to 96th Street. SECTION 2. THAT the City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 3. THAT all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 4. THAT all highways or streets not specifically set forth in the pre ceeding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prim.a facie speed limit Ordinances except those with which it specifically conflicts. SECTION 5. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall, upon conviction, be fined any sum not to exceed TWO HUNDRED ($200.00) DOLLARS.
