HomeMy WebLinkAboutOrdinance - 7702-1978 - Ordinance 7702 Authorinzing Issuance Of Specific Use Permit/Zone Case No. 1153-E - 08/10/1978/ ,... .R •t-h ORDINANCE NO. 7702 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMIT TO WIT: ZONE CASE NO. 1153-E; CHANGE A TRACT OF LAND OUT OF .SECTION 6, BLOCK E-2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM C-3 TO C-3 SPECIFIC USE PERMIT; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, after receiving the recommendations of the Planning and Zoning Commission and after due notice and public hearing and all matters having been done and performed as required by Section 22 of Zoning Ordinance No. 7084 of the City of Lubbock (said Ordinance being an Appendix to the Lubbock City Code) relating to Specific Use Permits, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to authorize the granting of the Specific Use Permit as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Director of Planning of the City of Lubbock is author- ized to issue a Specific Use Permit to the Applicant in Zone Case No. 1153-E in accordance with the recommendations and conditions imposed by the Planning and Zoning Commission, on file with the office of the Director of Planning and the City Council which are hereby adopted and incorporated herein by reference for all purposes, provided said applicant agrees to be bound by the terms of the Specific Use Permit, the granting of which is hereby made subject to compliance to all provisions of Zoning Ordinance No. 7084, an Ordinance of the City of Lubbock, including particularly, but not limited to Section 22 of Zoning Ordinance No. 7084, which provides that a Specific Use Permit and a Building Permit shall be applied for and secured within thirty-six (36) months of the effective date of the zone change or all undeveloped property shall automati- cally revert back to the previous zoning classification; and the Director of Planning in such event is directed to remove from the Zoning Map the legend indicating such limited use. The Specific Use authorized by this Ordinance is permitted under provision of Section 22.3-13 of the Zoning Ordinance on the property respectively described below. ZONE CASE NO. 1153-E Change a tract of land out of Section 6, Block E-2, City of Lubbock, Lubbock County, Texas, from C-3 to C-3 Specific Use Permit. This property is further described by metes and bounds as follows: j BEGINNING at a point for the Northeast and beginning corner of this tract, whence the Northeast corner of Section 6, Block E-2, bears East 70.00 feet and North 579.95 feet; THENCE South along the West line of Slide Road a distance of 322.50 feet to a 3/4" iron pipe, for the Southeast corner of this tract; THENCE Sou.th 65° 04' 00" West 242.62 feet to a 3/8" iron rod, for a corner of this tract; THENCE North at 54.78 feet past a 3/8" iron rod, continuing for a total distance of 209.78 feet to a 3/811 iron rod for a corner of this tract; THENCE West 245.03 feet to a 3/8" iron rod for a corner of this tract; THENCE North 36° 07' 38" West 245.03 feet to a 3/8" iron rod for a corner of this tract; -~ LB: th THENCE South 53° 52' 2211 West 155.00 feet to a 3/8" iron rod for a corner of this tract; THENCE North 36° 07' 38" West 220.00 feet to a 3/8" iron rod set for the Southwest corner of this tract; THENCE North 53° 52' 2211 East along the Southeasterly R.O.W. line of the Brownfield Highway to an "x" on the walk for the Northwest corner of this tract; THENCE South 36° 07' 38" East 355.78 feet to a 3/8" iron rod for a corner of this tract; THENCE East 355.78 feet to the PLACE OF BEGINNING. SECTION 2. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause publi- cation of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
