AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE Cl.TY
OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1437-H; CHANGE A TRACT
OF LAND OUT OF SECTION 22, BLOCK A, CI.TY OF LUBBOCK, LU.BBOCK COUNTY, TEXAS, FROM R-3
SPECIFIC USEPPERMIT TO A-1 ZONING DISTRICT; PROVIDING A SAVINGS CLAUSE AND PROVIDING
FOR PUBLICATION.
WHEREAS, the proposed change in zoning districts as hereinafter made ha.been
duly presented to the Planning' and Zoning· Commission for its recommendation which was
received by the City Council and, after due consideration, the City Council finds
that making the proposed change as hereinafter set out will be in the public inter-
est; and; ·
WHEREAS, all conditions precedent required by law for a valid amendment to the
Zoning Ordinance and Map have been fully complied with, as well as giving notices
in· c·ompl iance with Section 26 of Ordinance ~o. 7084, as well as no'tices· provided by
Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was
duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days
prior to the date of the public heiring before the City Council on such proposed
amendment, and the public hearing according to said notice was duly held in the
City Counci J Room on the second floor of the City HaJl, Lubbock, Texas, at which
time persons appeared in support of the proposal; and, after said hearing, it was
by the City Council determined that it would be in the public interest,' due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the
man'ner hereinafter set forth in the body of this Ordinance and this Ordinance having
been introduced prior to first readi_ng hereof; NOW THEREFORE: ·
BE IT ORDAINED BY THE Cl.TY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 7084 and the Official Zoni_ng Map BE and the same
are hereby amended -as follows, to-wit:
ZONE CASE NO. 1437-H
Change a tract of land out of Section 22, Block A, City of Lubbock,
Lubbock County, Texas, from R-3 Specific ·use'Permit to A-1 zoning
district. This property is further descr(bed by metes and boun·ds
as fol lows:
BEGINNING at a point which bears East 2672.12 feet and North
3518.81 feet from the Southwest corner of Section 22, -sJock A,
T. T. RR. Co. Survey, Lubbock County, Texas, the west corner
of this tract of land and the POINT OF BEGINNING;
THENCE North 53°03 1 East, 930.60 feet along the Southerly
rig ht-of-way 1 i ne of Loop 289 to the ;fi16rt'h corner of this tract
of land;
THENCE South 880.28 feet-.w~e .'SQ.Jtheast corner of this tract
L of land;
THENCE West 120.00 feetttoa point;
THENCE North 10.00 feet to a point;
THE~CE West 152.04 feet to a point;
THENCE South 53°03 1 West, 190.12 feet to a point in the Easterly
right-of-way line of Utica Drive, the South corner of this tract
of land;
THENCE North 36°571 West, 532.00 feet along the Easterly right-
of-way line of Utica Drive, to the West c·orner, the POINT OF
BEGINNING.

SECTION 2. THAT from and after passage and effective date of this Ordinance
said lots, tracts and ~arcels of land deicribed in Section 1 hereof shall be chan~ed
to the zoning district indicated and the Official Map is amended in accordance h·ere-
wi th. .
SECTION 3. THAT should any section, paragraph, sentence, clause, p'hrase or word
of this Ordinance be declared unconstitution~l or invalid for any reason, the. remain-
der of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publ icat'ion ofi
the descriptive caption of this Ordinance as an alternative method provided by law.
